Cuddle Purchase, Billing, Cancellation & Refund Terms

1. Introduction and Scope

1.1 What These Terms Are

These Purchase, Billing, Cancellation & Refund Terms (“Purchase Terms”) apply to purchases of Cuddle-operated digital Service functionality made available by Third Hub US, Inc., a Delaware corporation, d/b/a Cuddle (“Cuddle,” “we,” “us,” or “our”).

These Purchase Terms are Additional Terms under the Cuddle Terms of Service. By purchasing or using a Paid Feature, using checkout, requesting billing support, requesting cancellation, requesting a refund, disputing a charge, or otherwise interacting with payment-related features, you agree to these Purchase Terms.

1.2 What These Terms Cover

These Purchase Terms explain how purchases, checkout, payment authorization, prices, taxes, receipts, billing descriptors, digital delivery, Paid Feature access, subscriptions if offered, trials or promotions if offered, cancellations, refunds, chargebacks, payment disputes, fraud prevention, payment-risk management, billing support, and related records work.

Paid Features are sold only for access to Cuddle-operated digital Service functionality. Payments on Cuddle are made only to Cuddle and are not payments to or for another user.

1.3 Relationship to Other Terms

These Purchase Terms should be read together with the Terms of Service, Privacy Policy, Paid Features Terms, Prohibited Services, Payments & Commerce Policy, State-Specific Terms & Cancellation Notices, Contact / Legal Notices, checkout disclosures, purchase-specific terms, and applicable law.

If there is a conflict between these Purchase Terms and the Terms of Service regarding purchases, checkout, payment authorization, prices, taxes, billing, billing descriptors, digital delivery, cancellations, refunds, chargebacks, payment disputes, no cash value, no stored value, payment-risk controls, or purchase-specific disclosures, these Purchase Terms control for that subject matter.

If there is a conflict regarding personal information, the Privacy Policy controls. If there is a conflict regarding Paid Feature functionality, the Paid Features Terms control. If there is a conflict regarding prohibited services, prohibited payments, user-to-user transfers of value, stored value, wallet balances, gift cards, cryptocurrency, money transmission, financial services, adult content monetization, sexual services, escort services, compensated dating, or sugar arrangements, the Prohibited Services, Payments & Commerce Policy controls for that subject matter. If there is a conflict regarding non-waivable state-specific rights, applicable law and the State-Specific Terms & Cancellation Notices control to the extent required.

1.4 No Authorization of Prohibited Activity

Nothing in these Purchase Terms, checkout disclosures, purchase-specific terms, receipts, billing communications, cancellation communications, refund communications, support communications, or Paid Features authorizes user-to-user payments, tips, donations, payouts, stored value, wallet balances, gift cards, cryptocurrency, money transmission, financial services, adult content monetization, sexual services, escort services, compensated dating, sugar arrangements, or any other prohibited service or prohibited payment.

2. Paid Features and What You Are Purchasing

2.1 Paid Features Are Optional

Cuddle may offer optional Paid Features.

“Paid Features” means Cuddle-operated digital Service functionality made available for purchase or paid access. Paid Features may include fixed-term access, non-renewing memberships, passes, boosts, discovery features, visibility features, communication features, account features, safety features, promotional access, subscriptions if clearly disclosed at checkout, or similar non-transferable digital Service functionality made available by Cuddle.

Paid Features are optional unless Cuddle clearly states that payment is required before you purchase.

2.2 You Are Purchasing Cuddle Service Functionality

When you purchase a Paid Feature, you are purchasing access to Cuddle-operated digital Service functionality.

Payments on Cuddle are made only to Cuddle. Paid Features are not payments to other users, payments on behalf of other users, compensation, tips, donations, gifts, rewards, reimbursements, payouts, or transfers of value to another user.

Paid Features do not create any right to receive money, value, goods, services, in-person interaction, off-platform interaction, content, companionship, sexual content, sexual services, matches, replies, conversations, meetings, dates, relationships, compatibility, user safety, user truthfulness, user identity, user intentions, user availability, visibility, engagement, or any particular outcome.

2.3 No Cash Value, Stored Value, Wallet, or Transferability

Paid Features are limited, revocable, non-exclusive, non-transferable licenses to access Cuddle-operated digital Service functionality, subject to these Purchase Terms, the Terms of Service, the Paid Features Terms, checkout disclosures, purchase-specific terms, and applicable law.

Paid Features have no cash value and are not money, electronic money, stored value, prepaid value, wallet balances, gift cards, cash-equivalent instruments, payment instruments, deposits, cryptocurrency, digital assets, securities, rewards convertible to cash, financial products, or financial services.

Paid Features may not be sold, resold, assigned, transferred, traded, pledged, brokered, exchanged, cashed out, withdrawn, redeemed for cash, used to pay another user, used to tip another user, used to compensate another user, used to reimburse another user, or used to transfer value to any user or third party.

2.4 No Prohibited-Service or User-Monetization Purchases

Cuddle does not sell Paid Features for adult content monetization, pornography, adult live-chat, sexual services, escort services, prostitution, compensated dating, sugar arrangements, paid companionship, paid intimate content, paid sexual messaging, commercial sexual services, paid meetings, payment for access to a user, payment for a date, payment for a conversation, payment for intimacy, payment for sexual content, or any other prohibited service or prohibited payment.

If you attempt to use a Paid Feature, checkout, billing process, message, profile, link, QR code, external platform, payment handle, wallet address, or off-Service communication for any prohibited service, prohibited payment, user-to-user transfer of value, or financial service, Cuddle may take action permitted by the Terms of Service, these Purchase Terms, the Prohibited Services, Payments & Commerce Policy, and applicable law.

2.5 Relationship to Paid Features Terms

The Paid Features Terms may provide additional details about specific Paid Features, including functionality, access periods, limits, expiration, availability, delivery, non-transferability, and feature-specific restrictions.

If there is a conflict between these Purchase Terms and the Paid Features Terms regarding the functionality or use of a specific Paid Feature, the Paid Features Terms control for that subject matter, except where these Purchase Terms, checkout disclosures, purchase-specific terms, State-Specific Terms & Cancellation Notices, or applicable law provide a more specific purchase, billing, cancellation, refund, payment, or consumer right.

3. Checkout Disclosures, Prices, Taxes, and Purchase Terms

3.1 Checkout Information

Before you complete a purchase, the checkout flow will display the material purchase information applicable to that purchase.

This may include the Paid Feature being purchased, included functionality, price, currency, applicable taxes or fees, access period, delivery timing, renewal terms if any, trial or promotional terms if any, cancellation information, refund information, billing descriptor information, payment authorization terms, and purchase-specific terms.

You should review the checkout information carefully before completing a purchase.

3.2 Your Purchase Agreement

By completing a purchase, clicking a purchase button, checking a box, submitting payment information, authorizing payment, or otherwise confirming a purchase, you agree to the checkout disclosures, these Purchase Terms, the Terms of Service, the Paid Features Terms, the Privacy Policy, any purchase-specific terms, and any other terms presented to you for that purchase.

If you do not agree to the information shown at checkout, you should not complete the purchase.

Your purchase agreement may be shown through electronic records, checkout records, clickwrap records, payment authorization records, account records, receipt records, support records, or other records maintained by or on behalf of Cuddle.

3.3 Prices, Taxes, and Fees

Prices, taxes, fees, discounts, promotions, packages, access periods, feature limits, and availability may change from time to time.

Different users may see different prices, offers, taxes, payment methods, checkout flows, access terms, or product experiences depending on lawful factors such as location, state-specific requirements, feature availability, product testing, account status, payment-risk signals, fraud-prevention needs, payment processor requirements, service-provider requirements, legal requirements, tax requirements, or operational needs.

Cuddle may calculate, collect, remit, or document taxes or fees. Taxes and fees may depend on your billing information, location, payment method, purchase type, applicable law, payment processor requirements, or other relevant factors.

Unless required by applicable law or expressly stated at checkout, a later price change, discount, promotion, tax change, fee change, or offer does not entitle you to a refund, price match, cash-out, transfer, or other compensation for a prior purchase.

3.4 Purchase-Specific Terms

Some purchases may have purchase-specific terms. These may address price, access period, included functionality, renewal terms if any, trial terms if any, promotional terms if any, delivery timing, cancellation method, refund treatment, billing descriptor information, payment authorization, or state-specific notices.

If purchase-specific terms or checkout disclosures conflict with a more general provision in these Purchase Terms, the purchase-specific terms or checkout disclosures control for that specific purchase to the extent they are more specific or give you greater rights, unless applicable law requires otherwise.

3.5 Errors, Corrections, and Prohibited Activity

We may correct errors, inaccuracies, or omissions in prices, taxes, fees, promotions, descriptions, availability, checkout information, receipts, billing information, or purchase-specific terms.

If we discover a material error, we may cancel, decline, reverse, correct, or adjust the purchase where permitted by law. If you were charged for a purchase that Cuddle cancels because of an error, we will provide any refund required by applicable law or the applicable purchase terms.

Nothing in checkout, pricing, receipts, purchase-specific terms, or these Purchase Terms authorizes user-to-user payments, tips, donations, payouts, stored value, wallet balances, gift cards, cryptocurrency, money transmission, financial services, adult content monetization, sexual services, escort services, compensated dating, sugar arrangements, or any other prohibited service or prohibited payment.

4. Payment Authorization and Payment Processors

4.1 Payment Authorization

By completing a purchase, submitting payment information, clicking a purchase button, checking a box, authorizing payment, or otherwise confirming a purchase, you authorize Cuddle and its authorized third-party payment processors to charge the payment method you provide for the amount disclosed at checkout, including applicable taxes and fees.

You represent that you are authorized to use the payment method you submit and that the payment information you provide is accurate, current, complete, and not fraudulent, stolen, unauthorized, or misleading.

A payment authorization does not guarantee that a transaction will be approved, delivered, renewed, refunded, or remain available. Transactions may be reviewed, delayed, declined, canceled, reversed, restricted, or blocked as described in these Purchase Terms, the Terms of Service, checkout disclosures, payment processor rules, card-network rules, bank requirements, or applicable law.

4.2 Payment Processors

Cuddle uses authorized third-party payment processors to process purchases of Cuddle-operated digital Service functionality. Stripe may be used only if Stripe has approved and enabled payment processing for Cuddle’s applicable business model and jurisdiction.

Third-party payment processors and related providers may process payment information under their own terms, privacy policies, security practices, processor requirements, card-network rules, bank requirements, and legal obligations.

Processor, card-network, bank, payment-method provider, or other payment-provider decisions may affect authorization, settlement, refund timing, dispute handling, payment-method availability, and transaction completion.

4.3 Payment Card and Bank Information

Cuddle does not collect, store, or process full payment card numbers, card security codes, or full bank account credentials on Cuddle-controlled systems.

Payment card data is submitted directly to a third-party payment processor through processor-hosted, processor-controlled, or processor-approved payment fields or payment flows.

Cuddle may receive limited payment-related and billing-related information, such as payment method type, limited payment method details where available, billing information, billing location, transaction amount, currency, tax information, purchase date, Paid Feature purchased, payment status, receipt information, refund records, cancellation records, chargeback records, processor transaction identifiers, fraud-prevention signals, payment-risk signals, device information, session information, IP address information, and related records reasonably necessary for payment, billing, refund, cancellation, chargeback, tax, accounting, audit, compliance, and support purposes.

4.4 Failed Payments and Payment Method Issues

If a payment fails, is declined, is reversed, is disputed, appears unauthorized, or cannot be processed, we may decline the purchase, delay delivery, suspend or restrict access to the relevant Paid Feature, request updated payment information, require additional verification, block a payment method, or take other action permitted by these Purchase Terms, the Terms of Service, checkout disclosures, payment processor requirements, or applicable law.

You are responsible for expired payment methods, insufficient funds, payment-method limitations, bank declines, card-network restrictions, payment-provider rules, or incorrect billing information associated with your purchase, except to the extent applicable law provides otherwise.

4.5 No User Payment Processing

Cuddle does not provide payment processing services to users and does not operate as a payment facilitator, money transmitter, stored-value provider, wallet provider, gift card issuer, bank, lender, broker, financial institution, securities service, financial advisor, money services business, cryptocurrency service, digital asset service, or other financial service provider.

Nothing in this Section authorizes user-to-user payments, tips, donations, payouts, stored value, wallet balances, gift cards, cryptocurrency, money transmission, adult content monetization, sexual services, escort services, compensated dating, sugar arrangements, or any other prohibited service or prohibited payment.

5. Receipts, Billing Descriptors, Delivery, and Access

5.1 Receipts and Purchase Records

After a purchase is completed or attempted, Cuddle or its authorized third-party payment processor may provide a receipt, invoice, confirmation email, account notice, checkout record, payment status record, or other purchase record.

Purchase records may include the Paid Feature purchased, purchase date, transaction amount, currency, applicable taxes or fees, payment status, limited payment method details where available, billing descriptor information, processor transaction identifiers, cancellation or refund information where applicable, and other information reasonably necessary for billing, support, tax, accounting, audit, fraud prevention, payment-risk, chargeback, dispute, and legal-compliance purposes.

5.2 Billing Descriptors

Your bank, card issuer, payment provider, or statement may show a billing descriptor connected to Cuddle, Third Hub US, Inc., an authorized payment processor, or another descriptor disclosed at checkout, in a receipt, or through a billing-support communication.

Billing descriptors may vary depending on the payment processor, payment method, issuing bank, acquiring bank, card network, billing location, currency, or operational requirements.

If you do not recognize a charge, contact billing@cuddle-global.com before initiating a chargeback where possible.

5.3 Digital Delivery and Access

Paid Features are digital features. Unless checkout disclosures or purchase-specific terms state otherwise, delivery may occur immediately or shortly after payment authorization.

Access may depend on successful payment authorization, account status, feature availability, technical availability, jurisdictional availability, fraud-prevention review, payment-risk review, legal compliance, service-provider requirements, payment processor requirements, card-network rules, bank requirements, and compliance with these Purchase Terms and the Terms of Service.

5.4 Access Limits

Cuddle does not guarantee that any Paid Feature will always be available, uninterrupted, error-free, compatible with every device or browser, available in every jurisdiction, or supported by every payment method, payment processor, card network, bank, or service provider.

If we reasonably determine that a purchase, account, payment method, device, IP address, billing information, or other signal creates fraud, payment, chargeback, sanctions, legal, safety, security, or compliance risk, we may delay, decline, restrict, suspend, revoke, or refuse access to the related Paid Feature to the fullest extent permitted by law.

6. Subscriptions, Automatic Renewal, Trials, and Promotions

6.1 Subscriptions Only If Clearly Disclosed

Cuddle may offer auto-renewing subscriptions or recurring billing plans only if they are clearly disclosed at checkout.

Unless the checkout page and applicable purchase terms clearly state that a Paid Feature automatically renews, your purchase does not automatically renew, and Cuddle will not charge you again for that Paid Feature without your separate authorization.

Subscriptions, if offered, are Paid Features for access to Cuddle-operated digital Service functionality only. They are not payments to other users, payments on behalf of other users, compensation, tips, donations, payouts, transfers of value, or payments for matches, replies, conversations, meetings, dates, relationships, sexual content, sexual services, companionship, user access, or any particular outcome.

6.2 Renewal Disclosures and Authorization

If you purchase an auto-renewing subscription or recurring billing plan, the checkout flow will display the material renewal information applicable to that purchase before you authorize recurring billing, to the extent required by applicable law.

This may include the subscription being purchased, included functionality, initial price, renewal price, currency, applicable taxes or fees, billing frequency, renewal date or renewal period, trial terms if any, promotional terms if any, cancellation method, how to avoid renewal, renewal notices where required, refund information, billing descriptor information, and other legally required information.

By purchasing an auto-renewing subscription or recurring billing plan, you authorize Cuddle and its authorized third-party payment processors to charge your payment method on a recurring basis according to the terms disclosed at checkout until you cancel, unless applicable law or the applicable purchase terms provide otherwise.

6.3 Cancellation Before Renewal

You are responsible for canceling any auto-renewing subscription before the applicable renewal date if you do not want it to renew.

A cancellation may stop future renewal charges, but it does not automatically refund amounts already charged or unused time in a current access period unless a refund is required by applicable law, expressly stated at checkout, provided in purchase-specific terms, provided in these Purchase Terms, provided in the Paid Features Terms, provided in the State-Specific Terms & Cancellation Notices, or approved by Cuddle.

Deleting your account, stopping use of the Service, failing to log in, clearing cookies, blocking emails, disabling notifications, losing access to a device, losing access to a payment method, unmatching, blocking, suspension, restriction, or termination is not the same as cancellation, except where expressly provided by applicable law or applicable purchase terms.

6.4 Trials and Promotions

Cuddle may offer trials, introductory pricing, discounts, promotional access, or other promotional offers from time to time.

Trial and promotional terms may include eligibility requirements, duration, included functionality, price, renewal terms if any, conversion terms if any, cancellation requirements, offer limits, account limits, payment-method requirements, jurisdiction limits, and expiration dates.

A trial or promotion converts to a paid or auto-renewing subscription only if that conversion is clearly disclosed before you authorize the trial or promotion, to the extent required by applicable law.

Promotions are personal, non-transferable, and may not be sold, resold, traded, brokered, assigned, combined, duplicated, abused, or used to evade payment-risk controls, fraud-prevention systems, eligibility limits, account restrictions, purchase limits, or these Purchase Terms.

6.5 Renewal Notices, Price Changes, and Failed Renewals

Where required by applicable law, Cuddle will provide renewal notices, reminder notices, confirmation emails, online cancellation methods, consent records, or other renewal-related notices or tools.

If the price, billing frequency, renewal terms, included functionality, or other material subscription terms change, Cuddle will provide notice or seek consent where required by applicable law.

If a renewal payment fails, is declined, is disputed, appears unauthorized, or cannot be processed, we may retry the payment where permitted, request updated payment information, suspend or restrict access to the subscription, cancel the renewal, block a payment method, require additional verification, or take other action permitted by these Purchase Terms, the Terms of Service, payment processor requirements, or applicable law.

6.6 No Prohibited Subscription or Promotional Use

Subscriptions, trials, promotions, and renewal processes may not be used for user-to-user payments, tips, donations, payouts, stored value, wallet balances, gift cards, cryptocurrency, money transmission, financial services, adult content monetization, sexual services, escort services, compensated dating, sugar arrangements, paid companionship, or any other prohibited service or prohibited payment.

Cuddle may deny, revoke, restrict, or refuse subscription access, trial access, promotional access, renewal, or related benefits where we reasonably determine that the account, payment method, transaction, device, IP address, billing information, or activity creates fraud, payment-risk, safety, legal, compliance, chargeback, or prohibited-use concerns.

7. Cancellation Methods and Timing

7.1 When Cancellation Applies

Cancellation applies only to Paid Features that are cancellable under the applicable checkout disclosures, purchase-specific terms, these Purchase Terms, the Paid Features Terms, the State-Specific Terms & Cancellation Notices, an external purchase channel’s rules, or applicable law.

A one-time, fixed-term, non-renewing, or already-delivered Paid Feature may not require cancellation because it does not renew, unless the checkout disclosures, purchase-specific terms, these Purchase Terms, or applicable law provide otherwise.

If Cuddle offers an auto-renewing subscription or recurring billing plan, you are responsible for canceling before the applicable renewal date if you do not want future renewal charges.

7.2 How to Cancel

Unless a different cancellation method is required by applicable law, stated at checkout, provided in purchase-specific terms, required by an external purchase channel, or listed in the State-Specific Terms & Cancellation Notices, cancellation requests may be sent to:

Cuddle may also provide an account settings tool, online cancellation method, support form, or other cancellation method where required by law or made available by Cuddle.

Your cancellation request should include enough information for us to identify your account and purchase, such as your name, account email or phone number, account identifier if available, Paid Feature or subscription if offered, approximate purchase date, transaction amount, receipt or transaction identifier if available, and a clear statement that you want to cancel.

Do not send full payment card numbers, card security codes, full bank account credentials, passwords, authentication codes, government identification documents, biometric information, private keys, cryptocurrency wallet credentials, or other highly sensitive information by ordinary email unless Cuddle specifically requests it through an appropriate method.

7.3 What Is Not Cancellation

Deleting your account, stopping use of the Service, failing to log in, clearing cookies, blocking emails, disabling notifications, losing access to a device, losing access to a payment method, unmatching, blocking, muting, reporting another user, being suspended, being restricted, or being terminated is not the same as cancellation, except where expressly provided by applicable law or applicable purchase terms.

You should use the cancellation method that applies to the purchase if you want to cancel a subscription, recurring billing plan, renewal, or other cancellable Paid Feature.

7.4 Timing and Effect of Cancellation

A cancellation request may need to be received and processed before the applicable renewal date to prevent a future charge.

Processing time may depend on the information you provide, account verification, purchase identification, payment processor requirements, external purchase channel rules, fraud-prevention review, payment-risk review, legal requirements, support volume, technical availability, or other operational factors.

A cancellation may stop future renewal charges, but it does not automatically refund amounts already charged, reverse completed purchases, restore expired access, extend access, or provide compensation for unused time unless a refund or other remedy is required by applicable law, expressly stated at checkout, provided in purchase-specific terms, provided in these Purchase Terms, provided in the Paid Features Terms, provided in the State-Specific Terms & Cancellation Notices, or approved by Cuddle.

7.5 Confirmation and Records

Cuddle may send a cancellation confirmation, support response, account notice, email notice, receipt update, or other record when a cancellation is processed.

You should keep any cancellation confirmation or related communication for your records.

Cuddle may create and retain cancellation records, support records, account records, purchase records, payment records, refund records, chargeback records, fraud-prevention records, payment-risk records, and related records where reasonably necessary for billing support, legal compliance, payment disputes, chargebacks, fraud prevention, payment-risk management, tax, accounting, audit, enforcement, and protection of users and the Service.

7.6 Non-Waivable Rights

Nothing in this Section limits any non-waivable cancellation, refund, payment, unauthorized-transaction, consumer-protection, disability-related, death-related, relocation-related, automatic-renewal, online-cancellation, dating-service, or other right you may have under applicable law.

If applicable law requires a different cancellation method, timing rule, notice, confirmation, refund treatment, or consumer right, Cuddle will comply to the extent required.

8. Refund Rules

8.1 General Refund Rule

Except where required by applicable law, expressly stated at checkout, provided in purchase-specific terms, provided in these Purchase Terms, provided in the Paid Features Terms, provided in the State-Specific Terms & Cancellation Notices, or approved by Cuddle, purchases are final, non-refundable, and non-transferable.

This rule applies to one-time purchases, fixed-term access, non-renewing memberships, passes, boosts, promotional access, subscriptions if offered, and other Paid Features.

A refund is not guaranteed because you stop using the Service, delete your account, fail to cancel before renewal, do not receive matches, replies, conversations, meetings, dates, relationships, visibility, engagement, compatibility, or a particular result, or decide that a Paid Feature did not meet your expectations.

8.2 Refund Requests

You may request a refund by contacting:

Your request should include enough information for us to identify your account and purchase, such as your name, account email or phone number, account identifier if available, purchase date, transaction amount, Paid Feature purchased, receipt or transaction identifier if available, and the reason for your request.

Do not send full payment card numbers, card security codes, full bank account credentials, passwords, authentication codes, government identification documents, biometric information, private keys, cryptocurrency wallet credentials, or other highly sensitive information by ordinary email unless Cuddle specifically requests it through an appropriate method.

8.3 How Refund Requests Are Reviewed

Refund requests may be reviewed based on applicable law, checkout disclosures, purchase-specific terms, account status, payment status, Paid Feature delivery or use, cancellation timing, state-specific rights, fraud-prevention review, payment-risk review, chargeback history, refund history, support history, and other relevant circumstances.

Cuddle may approve, deny, delay, limit, or request additional information for a refund request to the fullest extent permitted by law.

Submitting a refund request does not guarantee that a refund will be approved.

8.4 Refund Method and Timing

If a refund is approved or required, it will generally be issued to the original payment method where practicable, subject to payment processor, card-network, bank, payment-method provider, and other payment-provider rules and timelines.

Cuddle does not guarantee that an approved or required refund will appear on your statement within any particular time. Refund timing may depend on third-party payment processors, card networks, issuing banks, acquiring banks, payment-method providers, holidays, processing delays, risk reviews, or other factors outside Cuddle’s control.

If the original payment method is unavailable, expired, closed, restricted, blocked, or otherwise unable to receive a refund, the refund may be delayed, declined, or handled as permitted by applicable law and payment-provider rules.

8.5 No Refunds for External Transfers or Prohibited Payments

Cuddle does not refund, reverse, process, guarantee, mediate, or assume responsibility for money, gift cards, cryptocurrency, payment-app transfers, bank transfers, wire transfers, loans, investments, payment credentials, account credentials, verification codes, private keys, wallet credentials, or anything else of value sent to another user or third party outside Cuddle’s authorized checkout flow.

Such transfers are not Cuddle purchases and are not payments for Cuddle-operated digital Service functionality.

Nothing in these Purchase Terms requires Cuddle to refund or compensate you for losses involving user-to-user payments, tips, donations, payouts, stored value, wallet balances, gift cards, cryptocurrency, money transmission, financial services, adult content monetization, sexual services, escort services, compensated dating, sugar arrangements, paid companionship, or any other prohibited service or prohibited payment.

8.6 Enforcement Actions and Feature Changes

If your account, payment method, checkout access, or Paid Feature is restricted, suspended, terminated, revoked, blocked, limited, or disabled because of a violation or suspected violation of the Terms of Service, these Purchase Terms, the Paid Features Terms, the Prohibited Services, Payments & Commerce Policy, payment processor requirements, card-network rules, bank requirements, service-provider requirements, or applicable law, you are not entitled to a refund unless required by applicable law, expressly stated at checkout, provided in purchase-specific terms, provided in the State-Specific Terms & Cancellation Notices, or approved by Cuddle.

Cuddle may change, limit, suspend, discontinue, rename, reconfigure, or remove Paid Features to the fullest extent permitted by law. Unless required by applicable law or expressly stated at checkout, such changes do not entitle you to a refund, cash-out, transfer, price match, or other compensation.

8.7 Non-Waivable Rights

Nothing in this Section limits any non-waivable cancellation, refund, payment, unauthorized-transaction, chargeback, consumer-protection, disability-related, death-related, relocation-related, automatic-renewal, online-cancellation, dating-service, or other right you may have under applicable law.

If applicable law requires a different refund rule, notice, review process, method, timing, documentation, or remedy, Cuddle will comply to the extent required.

9. Chargebacks, Payment Disputes, and Unauthorized Transactions

9.1 Billing Questions First

If you have a question about an unrecognized charge, duplicate charge, failed payment, refund, cancellation, chargeback, reversal, retrieval request, unauthorized-transaction claim, or payment dispute, you may contact:

Please include enough information for us to identify your account and the relevant purchase, such as your name, account email or phone number, account identifier if available, purchase date, transaction amount, Paid Feature purchased, receipt or transaction identifier if available, payment method type if relevant, and a clear description of the issue.

Do not send full payment card numbers, card security codes, full bank account credentials, passwords, authentication codes, private keys, cryptocurrency wallet credentials, or other highly sensitive information by ordinary email unless Cuddle specifically requests it through an appropriate method.

9.2 Your Payment Provider Rights

Nothing in these Purchase Terms limits any non-waivable right you may have under applicable law or under your agreement with your payment provider, card issuer, bank, payment-method provider, or other payment provider.

This may include rights relating to unauthorized transactions, billing errors, chargebacks, reversals, retrieval requests, or similar payment-provider procedures.

However, using a payment-provider process does not automatically resolve, waive, or replace any dispute between you and Cuddle.

9.3 Records We May Use and Disclose

If you initiate a chargeback, payment dispute, reversal, retrieval request, refund dispute, billing dispute, unauthorized-transaction claim, or similar process, Cuddle may use and disclose information reasonably relevant to the dispute.

Relevant information may include account records, checkout records, payment authorization records, clickwrap records, consent records, receipts, invoices, billing communications, cancellation records, refund records, chargeback records, transaction records, login records, device information, browser information, session information, IP address information, Paid Feature usage records relevant to the purchase or dispute, support communications, fraud-prevention records, payment-risk records, account-status records, enforcement records where relevant, and other information reasonably necessary to respond to the dispute.

Recipients may include payment processors, card networks, issuing banks, acquiring banks, payment-method providers, fraud-prevention vendors, payment-risk vendors, service providers, professional advisors, regulators, courts, law enforcement, or other lawful authorities.

9.4 False or Bad-Faith Disputes

You may not submit false, fraudulent, abusive, misleading, retaliatory, or bad-faith chargebacks, payment disputes, unauthorized-transaction claims, refund disputes, or billing disputes.

If we reasonably believe that a payment dispute is false, fraudulent, abusive, misleading, retaliatory, or submitted in bad faith, we may preserve records, respond to the dispute, restrict or suspend account access, block payment methods, restrict future purchases, revoke or restrict access to Paid Features, require additional verification, cooperate with payment processors, banks, card networks, regulators, law enforcement, courts, or other lawful authorities, and take other action permitted by these Purchase Terms, the Terms of Service, and applicable law.

9.5 Dispute Outcomes

A chargeback, payment dispute, reversal, retrieval request, refund dispute, billing dispute, or unauthorized-transaction claim may affect your account, payment method, checkout access, Paid Feature access, fraud-prevention review, payment-risk review, refund eligibility, and future purchases.

A payment-provider decision may affect whether a charge is reversed, refunded, upheld, or otherwise adjusted. Cuddle does not control all payment-provider, card-network, bank, or payment-method-provider timelines, rules, fees, or decisions.

9.6 No Disputes for External Transfers as Cuddle Payments

Cuddle does not process, reverse, refund, mediate, or resolve money, gift cards, cryptocurrency, payment-app transfers, bank transfers, wire transfers, loans, investments, payment credentials, verification codes, private keys, wallet credentials, or anything else of value sent to another user or third party outside Cuddle’s authorized checkout flow.

Such transfers are not Cuddle purchases and are not payments for Cuddle-operated digital Service functionality.

10. Fraud Prevention, Payment Risk, and Enforcement

10.1 Overview

Cuddle may review, delay, decline, cancel, reverse, restrict, suspend, revoke, or refuse transactions, purchases, payment methods, subscriptions if offered, Paid Features, accounts, devices, IP addresses, sessions, or other access points where we reasonably determine that doing so is necessary or appropriate for fraud prevention, payment-risk management, legal compliance, payment processor requirements, card-network rules, bank requirements, service-provider requirements, user safety, or Service integrity.

Fraud-prevention and payment-risk controls help protect users, Cuddle, payment processors, banks, card networks, service providers, and the Service.

10.2 Risk Reviews and Controls

We may use human review, automated review, machine-assisted tools, payment processor tools, fraud-prevention tools, payment-risk tools, linked-account analysis, device checks, IP checks, session checks, billing checks, velocity limits, transaction limits, purchase limits, payment-method blocks, checkout restrictions, verification requirements, account restrictions, and other controls.

These controls may be used to detect or respond to unauthorized payment use, stolen payment credentials, false billing information, card testing, payment-method testing, account takeover, refund abuse, chargeback abuse, promotional abuse, suspicious checkout behavior, suspicious transaction velocity, linked accounts, prohibited services, prohibited payments, user-to-user transfers of value, scams, or other misuse.

10.3 Actions We May Take

If a purchase, account, payment method, device, IP address, billing information, transaction, or other signal creates fraud, payment, chargeback, sanctions, legal, safety, security, compliance, or prohibited-use risk, we may take action to the fullest extent permitted by law.

Actions may include delaying or declining a transaction, canceling a purchase, restricting checkout access, blocking a payment method, requiring additional verification, limiting future purchases, suspending or terminating an account, revoking or restricting access to Paid Features, preserving records, responding to chargebacks or payment disputes, cooperating with payment processors or lawful authorities, and enforcing these Purchase Terms and the Terms of Service.

10.4 Prohibited Payment Activity

You may not use Cuddle, checkout, Paid Features, messages, profiles, external links, QR codes, payment handles, wallet addresses, external platforms, external payment apps, or off-Service communications to request, solicit, advertise, arrange, send, receive, process, disguise, or facilitate payments, money, gifts, gift cards, cryptocurrency, bank transfers, wire transfers, payment-app transfers, loans, investments, payment credentials, account credentials, verification codes, private keys, wallet credentials, or anything else of value from another user.

Cuddle does not provide user-to-user payments, tips, donations, payouts, stored value, wallet balances, gift cards, cryptocurrency, money transmission, banking, lending, investment services, adult content monetization, sexual services, escort services, compensated dating, sugar arrangements, or other prohibited services.

10.5 Records and Risk Logic

Cuddle may create, use, disclose, and retain fraud-prevention records, payment-risk records, checkout records, payment authorization records, failed payment records, refund records, cancellation records, chargeback records, payment-dispute records, account records, device records, IP records, support records, and related records where reasonably necessary for the purposes described in these Purchase Terms and our Privacy Policy.

We are not required to disclose detailed fraud models, risk scores, processor rules, card-network rules, bank rules, internal review criteria, automated decision logic, security controls, account-linking logic, or other sensitive operational information where disclosure could compromise fraud prevention, payment security, account security, user safety, investigations, legal compliance, confidential information, trade secrets, or the integrity of the Service.

10.6 Non-Waivable Rights

Nothing in this Section limits any non-waivable payment, chargeback, unauthorized-transaction, cancellation, refund, consumer-protection, privacy, appeal, or other right you may have under applicable law.

11. External Purchase Channels

11.1 Overview

Cuddle may make certain Paid Features available through an external purchase channel, such as an app store, device platform, browser platform, authorized platform purchase flow, or other purchase channel authorized by Cuddle.

This Section applies only where Cuddle expressly makes a Paid Feature available through an external purchase channel. It does not authorize user-to-user payments, external payment requests, tips, donations, payouts, stored value, wallet balances, gift cards, cryptocurrency, money transmission, adult content monetization, sexual services, escort services, compensated dating, sugar arrangements, or any other prohibited service or prohibited payment.

11.2 External Channel Terms

If you purchase through an external purchase channel, your purchase may also be subject to that channel’s terms, privacy policy, payment rules, refund rules, cancellation procedures, subscription-management procedures, taxes, fees, dispute procedures, security practices, and legal obligations.

Those external channel rules may control certain parts of the purchase process, including payment authorization, billing, receipts, billing descriptors, renewal management, cancellation method, refund timing, refund eligibility, payment disputes, and subscription settings.

You should review the applicable external channel terms before completing a purchase.

11.3 Cancellations and Refunds Through External Channels

For purchases made through an external purchase channel, you may need to manage billing, cancellation, refunds, or subscription settings directly through that external channel rather than through Cuddle, unless applicable law, checkout disclosures, purchase-specific terms, or the external channel rules provide otherwise.

Cuddle may have limited ability to cancel, refund, reverse, modify, or access information about purchases made through an external purchase channel.

If you contact Cuddle about an external-channel purchase, please include enough information for us to identify your account and purchase. We may direct you to the external channel where appropriate.

11.4 No External User Payments

External purchase channels are different from external payment apps or off-Service user payment requests.

You may not use external payment apps, payment handles, wallet addresses, QR codes, bank transfers, wire transfers, cryptocurrency, gift cards, or other off-Service methods to send money or value to another user.

Such transfers are not Cuddle purchases and are not payments for Cuddle-operated digital Service functionality.

12. State-Specific and Non-Waivable Rights

12.1 Overview

Certain U.S. states may provide specific cancellation rights, refund rights, dating service notices, automatic-renewal notices, online cancellation rights, death-related rights, disability-related rights, relocation-related rights, payment rights, fraud notices, or screening disclosures.

Additional state-specific information may be provided in our State-Specific Terms & Cancellation Notices, checkout disclosures, purchase-specific terms, Paid Features Terms, Terms of Service, Privacy Policy, or Contact / Legal Notices.

12.2 State-Specific Purchase, Cancellation, and Refund Rights

If applicable law gives you a right to cancel a qualifying dating service contract, Paid Feature, subscription if offered, renewal if offered, trial if offered, promotional offer, or other purchase within a specified period, Cuddle will honor that right to the extent required by law.

The applicable cancellation period, cancellation method, refund treatment, renewal treatment, confirmation requirement, and required notice may depend on the law that applies to your purchase.

12.3 Subscriptions, Trials, and Online Cancellation

Cuddle may offer auto-renewing subscriptions or recurring billing plans only if they are clearly disclosed at checkout.

If applicable law requires renewal notices, reminder notices, trial-conversion notices, online cancellation methods, consent, acknowledgment, confirmation emails, or other subscription-related steps, Cuddle will provide them to the extent required.

12.4 Death, Disability, Relocation, and Similar Rights

Certain state laws or purchase-specific terms may provide cancellation or refund rights if a user dies, becomes disabled, relocates, or experiences another legally recognized circumstance.

If such rights apply, an authorized person may submit a request through the cancellation channel or another method required by law. We may request information reasonably necessary to verify the request, account, purchase, authority to act, and legal basis for the request, and will process that information as described in our Privacy Policy.

12.5 Other Non-Waivable Rights

Nothing in these Purchase Terms limits any non-waivable payment, unauthorized-transaction, chargeback, billing-error, consumer-protection, privacy, cancellation, refund, automatic-renewal, online-cancellation, dating-service, or other right you may have under applicable law.

If applicable law requires a different notice, consent, cancellation process, refund rule, refund timing, payment-dispute process, documentation requirement, or remedy, Cuddle will comply to the extent required.

12.6 No Authorization of Prohibited Activity

No state-specific right, notice, cancellation right, refund right, subscription right, screening disclosure, fraud notice, or payment right permits users to use Cuddle for prohibited services, prohibited payments, user-to-user transfers of value, financial services, adult content monetization, sexual services, escort services, compensated dating, sugar arrangements, or any activity prohibited by the Terms of Service, these Purchase Terms, or applicable law.

Paid Features are sold only for access to Cuddle-operated digital Service functionality. They are not payments to other users, payments on behalf of other users, stored value, wallet balances, gift cards, cryptocurrency, financial products, or financial services.

12.7 Order of Priority

If there is a conflict between these Purchase Terms and applicable non-waivable law, applicable law controls to the extent required.

If there is a conflict between these Purchase Terms and the State-Specific Terms & Cancellation Notices regarding state-specific purchase, cancellation, refund, subscription, renewal, online-cancellation, dating-service, payment, consumer-protection, or other non-waivable rights, the State-Specific Terms & Cancellation Notices control.

These records may be used to process purchases, provide billing support, process cancellations and refunds, respond to chargebacks and payment disputes, prevent fraud, manage payment risk, comply with law, enforce these Purchase Terms, and protect users, Cuddle, payment processors, banks, service providers, and the Service.

13.3 Privacy and Other Terms

Our Privacy Policy explains how Cuddle processes personal information in connection with purchases, checkout, billing, cancellations, refunds, chargebacks, payment disputes, fraud prevention, payment-risk management, and support. If there is a conflict regarding personal information, the Privacy Policy controls.

These Purchase Terms are supplemented by the Terms of Service, Paid Features Terms, Prohibited Services, Payments & Commerce Policy, State-Specific Terms & Cancellation Notices, Contact / Legal Notices, checkout disclosures, purchase-specific terms, external purchase channel terms, and applicable law. More specific terms control the subject matter they address.

13.4 Changes

We may update these Purchase Terms. If we make material changes, we will update the Effective Date and provide notice as required by applicable law.

Your continued access to or use of the Service, checkout, or Paid Features after updated Purchase Terms become effective means that you agree to the updated Purchase Terms, except where applicable law requires a different process or consent.

No update to these Purchase Terms authorizes user-to-user payments, tips, donations, payouts, stored value, wallet balances, gift cards, cryptocurrency, money transmission, financial services, adult content monetization, sexual services, escort services, compensated dating, sugar arrangements, or any prohibited service or prohibited payment.
