Cuddle Criminal Background Screening Disclosure

1. Introduction, Scope, and Important Screening Notice

1.1 Purpose of This Disclosure

This Criminal Background Screening Disclosure (“Disclosure”) explains Cuddle’s current practices concerning criminal background screening, sex-offender-registry review, public-record review, age-eligibility review, identity-document review, government ID review, photo or selfie review, account review, and related safety limitations.

It helps users understand what Cuddle does and does not review. It does not mean that every member has been screened, verified, approved, cleared, or determined to be safe.

1.2 Important Criminal-Background-Screening Notice

CUDDLE DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS OR SEX-OFFENDER-REGISTRY CHECKS ON ALL MEMBERS.

Cuddle does not routinely or continuously screen every member against criminal-history records, sex-offender registries, court records, public-record databases, or similar sources before account creation, communication, Premium access, or continued use.

In limited, risk-based, report-based, or legally required circumstances, Cuddle may review publicly available government records or sex-offender registries, or request an identity-document review, government ID review, or photo or selfie review through an authenticated review flow made available through the Service.

A limited account review does not change the general rule that most members are not subject to criminal background screening.

1.3 Scope and Web-Based Service

This Disclosure applies to Cuddle’s websites and browser-based Service components, including registration, accounts, profiles, Likes, Matches, messaging, reports, safety and moderation processes, limited account reviews, and appeals.

It also addresses information or conduct reasonably connected to Cuddle where a report, credible information, legal requirement, or serious safety, fraud, impersonation, or account-integrity concern may lead to a limited review.

1.4 United States Availability and Adults Only

Cuddle is an 18+ online dating and social connection service offered to eligible adults located in the fifty states and the District of Columbia, unless Cuddle expressly states otherwise.

Minors may not create accounts, use the Service, appear in member content, communicate with users, purchase or use Premium, or otherwise participate.

1.5 Relationship to Other Terms

This Disclosure is an Additional Term under Cuddle’s Terms of Service.

The Terms of Service govern eligibility, accounts, safety, review, enforcement, and legal matters. The Safety Tips / Dating Safety Notice provides practical safety guidance. The Community Guidelines govern user-facing conduct. The Privacy Policy governs personal-information processing. The State-Specific Terms & Cancellation Notices govern applicable state-specific screening disclosures and non-waivable requirements.

A more specific review notice, state-specific notice, or non-waivable law controls the subject it addresses.

1.6 No Safety Guarantee and Emergency Limits

An identity-document review, government ID review, or photo or selfie review is not, by itself, a criminal background check, sex-offender-registry check, comprehensive identity verification, or safety clearance.

No absence of screening, screening result, public-record review, account review, account status, report response, moderation action, or continued access guarantees another member’s identity, age, background, criminal history, sex-offender status, truthfulness, safety, compatibility, availability, or future conduct.

Continue to use caution and your own judgment.

Cuddle is not an emergency-response service. If there is immediate danger or an urgent need for assistance, contact local emergency services.

2. Current Screening Practice: No Screening of Every Member and No Continuous Monitoring

2.1 Cuddle Does Not Screen Every Member

Cuddle does not conduct a criminal background check on every member before registration, account activation, profile display, communication, Premium access, or continued use.

Cuddle does not routinely search every member’s name or other information against criminal-history records, court records, public-record databases, or similar sources.

Most members are not expected to undergo criminal background screening. A person may create or maintain an account without Cuddle having searched for or reviewed that person’s criminal history.

2.2 No Sex-Offender-Registry Check on Every Member

Cuddle does not conduct a sex-offender-registry check on every member before the member may create an account, view profiles, send or receive Likes, form Matches, communicate, purchase or use Premium, or continue using the Service.

A person required to register as a sex offender may not use Cuddle under the Terms of Service. That eligibility rule does not mean Cuddle has checked every member against every state, national, or other available registry.

Registry availability, content, search functionality, update timing, and access may vary by jurisdiction.

2.3 No Continuous or Periodic Criminal-Record Monitoring of Every Member

Cuddle does not continuously or periodically monitor every member’s criminal history, court records, or sex-offender-registry status.

Cuddle does not promise routine re-screening, scheduled registry refreshes, or automatic notice of every arrest, charge, conviction, registry change, court event, or other record after account creation.

This does not mean Cuddle never monitors account or Service activity. Cuddle may use safety, moderation, security, fraud-prevention, payment-risk, and abuse-prevention tools as described in the Terms, Privacy Policy, and other applicable terms.

2.4 No Comprehensive Personal Investigation

Unless Cuddle expressly states otherwise for a particular process or legal requirement, Cuddle does not comprehensively investigate every member’s identity, relationship or marital status, intentions, employment, finances, health, immigration status, social-media activity, or general safety.

Email confirmation, phone-number verification, date-of-birth entry, account review, identity-document review, government ID review, or photo or selfie review is limited to its stated purpose. None is, by itself, a comprehensive identity verification, comprehensive background investigation, criminal background check, sex-offender-registry check, or safety clearance.

2.5 Account Access, Premium, and Continued Use Are Not Evidence of Screening

An account, profile, Like, Match, message, Premium purchase, active Premium period, account indicator, review result, report response, or continued access does not mean that Cuddle conducted or completed a criminal background check or sex-offender-registry check.

It also does not mean that Cuddle approved, endorsed, cleared, certified, or guaranteed the member, or completed any review beyond the limited purpose expressly stated.

2.6 Limited Reviews Do Not Change the General Rule

In limited, risk-based, report-based, or legally required circumstances, Cuddle may review credible information, publicly available government records, or sex-offender registries, or may request an identity-document review, government ID review, or photo or selfie review through an authenticated review flow made available through the Service.

Not every report results in a record search, and not every limited review involves criminal-history information. A photo or selfie review does not itself search criminal records or registries. A limited review of one member does not mean Cuddle screens all members or continuously monitors the reviewed member.

Sections 3 through 6 explain these distinctions, limitations, and possible actions.

2.7 Future Changes to Screening Practices

Cuddle may change its screening or review practices prospectively.

If Cuddle begins screening every member, introduces periodic criminal-record monitoring, materially changes its registry-review, identity-document, government-ID, or photo or selfie review practices, uses a materially different screening process, or changes an applicable exclusion policy, Cuddle will update this Disclosure and provide any notice, placement, acknowledgment, or other process required by law.

A future change does not mean that earlier members or earlier periods were screened.

3. Definitions and Distinctions Among Screening and Account-Review Processes

3.1 Why the Distinctions Matter

Cuddle uses different review processes for different purposes. They are not interchangeable.

A process used to assess age eligibility, account ownership, identity consistency, payment authority, fraud risk, safety, moderation, or compliance is not automatically Criminal Background Screening or a Sex-Offender-Registry Review. A limited review also does not mean that Cuddle routinely screens every member.

3.2 Criminal Background Screening

“Criminal Background Screening” means a process intended to search for, obtain, or evaluate criminal-history information concerning a person.

Depending on the process and lawful source, this may include conviction records, court records, criminal-history records, or public-record databases. It does not include ordinary registration, date-of-birth entry, email confirmation, phone-number verification, account moderation, payment-risk review, or review of a user report unless criminal-history information is searched or evaluated.

Cuddle does not conduct Criminal Background Screening on every member.

3.3 Sex-Offender-Registry Review

“Sex-Offender-Registry Review” means a search or review of a publicly available government sex-offender registry where lawful.

A registry review may be limited by available information, search functionality, jurisdiction, matching data, and update timing. Cuddle does not conduct a Sex-Offender-Registry Review on every member.

A person required to register as a sex offender may not use Cuddle under the Terms of Service.

3.4 Public-Record Review

“Public-Record Review” means a targeted review of publicly available government records or other lawful public sources.

Cuddle may conduct such a review after a serious report, credible information, a material safety or fraud concern, or where law requires or permits it. A Public-Record Review may be narrower than Criminal Background Screening and may concern only a specific issue, record, jurisdiction, or person.

Not every report results in a Public-Record Review.

3.5 Identity-Document or Government-ID Review

“Identity-Document or Government-ID Review” means a limited review of an identity document, government-issued identification, related document information, and associated account information for a stated purpose.

That purpose may include assessing account ownership, identity consistency, age eligibility, account recovery, impersonation, fraud, payment risk, safety, compliance, moderation, or enforcement.

This review does not itself search criminal records or sex-offender registries and is not a safety clearance.

3.6 Photo or Selfie Review

“Photo or Selfie Review” means a limited review of a photo or selfie submitted through Cuddle’s authenticated review flow, together with relevant account information, for a stated account, eligibility, safety, fraud-prevention, payment-risk, recovery, compliance, moderation, or enforcement purpose.

A Photo or Selfie Review is not Criminal Background Screening, a Sex-Offender-Registry Review, a comprehensive identity verification, or a safety clearance. It does not guarantee identity, age, account ownership, background, truthfulness, safety, or future conduct.

3.7 Age-Eligibility Review

“Age-Eligibility Review” means a process used to assess whether a person satisfies Cuddle’s eighteen-plus requirement.

It may use date-of-birth information, registration records, account information, contact confirmation, reports, or, where reasonably necessary, an Identity-Document or Government-ID Review or Photo or Selfie Review.

Age-eligibility review does not establish criminal history, relationship status, intentions, or safety.

3.8 Account-Ownership, Fraud-Prevention, Payment-Risk, and Moderation Review

Cuddle may review email confirmation, phone-number verification, account history, device, browser, IP-address, approximate-location, session, transaction, billing, payment-method, support, report, message, content, safety, moderation, and risk information.

These reviews may support account recovery, account security, fraud prevention, payment-risk management, report investigation, compliance, moderation, or enforcement. They are not Criminal Background Screening merely because they concern identity, risk, or misconduct.

3.9 What These Processes Do Not Establish

No screening or review process described in this Section, report response, account status, or continued access guarantees:

• identity, age, or account ownership;
• complete criminal history or sex-offender status;
• relationship or marital status;
• intentions, truthfulness, compatibility, or availability;
• employment, finances, health, immigration status, or social-media history; or
• safety or future conduct.

Each process is limited to its stated purpose, available information, applicable law, and the limitations described in this Disclosure.

4. Limited, Risk-Based, Report-Based, and Lawfully Required Reviews

4.1 When a Limited Review May Occur

Cuddle may conduct a limited review when reasonably necessary to address a serious safety, fraud, impersonation, account-integrity, eligibility, compliance, moderation, or enforcement concern.

A review may be prompted by a user report, credible information from a lawful source, suspicious account or transaction activity, a material inconsistency, a legal requirement, or information suggesting that a member may be ineligible under the Terms of Service.

A limited review is not routine screening of every member and does not create continuous monitoring.

4.2 User Reports and Other Credible Information

Cuddle may consider reports, complaints, screenshots, messages, profile information, support communications, account history, publicly available information, and other relevant records.

Information supplied by a user or third party may be incomplete, inaccurate, outdated, altered, fabricated, malicious, or misleading. Cuddle may seek clarification, compare available records, or decline to rely on information that cannot reasonably be assessed.

Submitting a report does not require Cuddle to conduct Criminal Background Screening, a Sex-Offender-Registry Review, a Public-Record Review, an Identity-Document or Government-ID Review, a Photo or Selfie Review, or any particular investigation.

4.3 Serious Safety, Fraud, Impersonation, and Account-Integrity Concerns

A limited review may be considered in connection with suspected violence, sexual misconduct, stalking, harassment, trafficking, grooming, child exploitation, threats, doxxing, blackmail, extortion, sextortion, serious fraud, financial exploitation, romance scams, impersonation, account takeover, suspected minor use, prohibited commercial activity, coordinated misconduct, or attempts to evade restrictions.

Cuddle may also review payment abuse, unauthorized payment use, transaction laundering, account farming, false eligibility information, or material account-ownership concerns.

Not every concern will involve criminal-history information.

4.4 Public Government Records and Sex-Offender Registries

Where permitted by law and reasonably relevant, Cuddle may review publicly available government records, court information, or sex-offender registries after a serious report, other credible information, or a legally recognized requirement.

A review may be limited to a particular person, allegation, jurisdiction, record type, or time period. Cuddle does not promise to search every database, jurisdiction, alias, record category, or foreign source.

A person required to register as a sex offender may not use Cuddle under the Terms of Service.

4.5 Information Used to Assess Whether a Record Relates to a Member

Cuddle may compare available record information with account information such as name, known aliases, date of birth, age, location, contact information, profile information, account history, and other lawful identifiers.

Where reasonably necessary, Cuddle may request an Identity-Document or Government-ID Review, a Photo or Selfie Review, or both through the authenticated review flow made available through the Service.

These methods may help assess identity consistency, account ownership, age eligibility, or whether information may relate to the member. They do not themselves search criminal records or sex-offender registries.

Matching may remain uncertain because information may be incomplete, inconsistent, common to multiple people, outdated, altered, or unavailable. Cuddle may treat a result as matched, unmatched, inconclusive, or requiring further review.

4.6 Human, Automated, and Machine-Assisted Tools

Cuddle may use human, automated, and machine-assisted tools to organize, compare, flag, prioritize, or review relevant information.

These tools may help identify inconsistencies, related accounts, possible record matches, fraud or payment-risk signals, or matters requiring human review. They may produce false positives or false negatives and may be delayed, incomplete, inaccurate, unavailable, or circumvented.

Cuddle does not represent that an automated flag, score, or comparison establishes identity, criminal history, wrongdoing, ineligibility, or safety.

4.7 Not Every Report Results in a Record Search

Cuddle may address a report through content review, account-history review, messaging or feature restrictions, clarification, an Identity-Document or Government-ID Review, a Photo or Selfie Review, fraud-prevention controls, moderation, or another proportionate process without searching criminal or registry records.

Cuddle may determine that available information is insufficient, unreliable, unrelated, outside scope, or not reasonably searchable.

4.8 Possible Actions Following Review

Depending on the available information, applicable terms, and law, Cuddle may take no action; request clarification or additional information; preserve records; remove or restrict content; limit profile visibility, discovery, Likes, Matches, messaging, checkout, payment methods, Premium, or other functionality; warn a user; suspend or terminate an account; block re-registration; notify affected members where required or appropriate; or cooperate with lawful authorities.

Cuddle is not required to use progressive discipline before stronger action.

4.9 No Required or Guaranteed Outcome

A report, credible allegation, record search, registry review, Public-Record Review, Identity-Document or Government-ID Review, Photo or Selfie Review, or other limited review does not guarantee a particular investigation, finding, disclosure, notice, account action, appeal result, or safety outcome.

Cuddle does not guarantee that every relevant record, identity inconsistency, or harmful act will be identified, matched, reviewed, reported, preserved, or resolved.

Nothing in this Section limits any non-waivable safety, reporting, appeal, privacy, consumer-protection, court-access, or other right under applicable law.

5. Sources, Record Coverage, Matching, Update Frequency, and Screening Limitations

5.1 Potential Sources of Information

Where Cuddle conducts a limited review, it may consider information reasonably relevant to the concern.

Potential sources may include publicly available government records, court records, sex-offender registries, account and profile information, reports, screenshots, support communications, prior moderation or enforcement records, materials submitted through Cuddle’s authenticated review flow, and information provided by the member or another lawful source.

Cuddle does not promise to obtain information from every source or conduct the same review in every matter.

5.2 Public Government Databases and Registry Availability

Government databases, court systems, and sex-offender registries differ by jurisdiction, coverage, accessibility, search method, update schedule, and permitted use.

A source may be unavailable, searchable only with particular information, limited to certain jurisdictions or record types, or subject to legal restrictions.

Cuddle does not guarantee access to every state, national, local, federal, or foreign source.

5.3 Name, Alias, Date-of-Birth, and Identifier Matching

Cuddle may compare available record information with a member’s name, known aliases, date of birth, age, location, contact information, profile information, account history, or other lawful identifiers.

Where reasonably necessary, Cuddle may request an Identity-Document or Government-ID Review, a Photo or Selfie Review, or both through the authenticated review flow made available through the Service.

Those reviews may help assess identity consistency, account ownership, age eligibility, or whether information may relate to the member. They do not themselves search criminal records or sex-offender registries.

Matching may remain uncertain because names may be common, aliases unknown, information incomplete, records differently formatted, or submitted materials inconclusive.

5.4 Sealed, Expunged, Nonpublic, Delayed, and Foreign Records

A review may not reveal sealed, expunged, confidential, juvenile, nonpublic, restricted, recently filed, delayed, unreported, or otherwise unavailable records.

It may omit records from unsearched jurisdictions, foreign countries, private databases, or systems without reliable public access.

Conduct that was never reported, investigated, charged, prosecuted, adjudicated, registered, or recorded may not appear in any searchable source.

5.5 Arrests, Convictions, Pending Matters, and Record Context

An arrest, allegation, charge, complaint, warrant, or pending matter does not by itself establish guilt or a final legal determination.

A conviction record may be incomplete, outdated, reversed, vacated, misclassified, or missing important context concerning identity, disposition, sentence, recency, or legal effect.

Cuddle may consider record reliability, disposition information, relevance, matching confidence, account conduct, reports, applicable law, and other available context. Section 6 explains possible access and enforcement decisions.

5.6 Update Frequency and No Routine Re-Screening

Targeted Criminal Background Screening, Sex-Offender-Registry Review, or Public-Record Review is not ordinarily rerun, continuously monitored, or periodically refreshed for every reviewed member.

Cuddle may conduct another review after new relevant information, a serious report, a material account change, a lawful request, or another reason described in this Disclosure.

A prior search result or account review may become outdated or cease to reflect current circumstances.

5.7 False Positives, False Negatives, and Matching Errors

A review may associate a record with the wrong person or fail to identify a record relating to the correct person.

Errors may result from common names, aliases, identity theft, incomplete identifiers, inaccurate account information, data-entry errors, stale records, jurisdictional differences, source limitations, altered or misleading materials, or unavailable information.

Human, automated, and machine-assisted tools may help organize or compare information but do not eliminate these risks.

5.8 “No Record,” “No Match,” “Clear,” and Inconclusive Results

A result described as “no record,” “no match,” “clear,” unavailable, or inconclusive does not mean that a member has no criminal history, has never engaged in harmful conduct, is not required to register elsewhere, or is safe to interact with.

It means only that the particular review did not identify a conclusive responsive record within the sources, information, scope, timing, and matching methods used.

An Identity-Document or Government-ID Review or Photo or Selfie Review likewise does not establish that no relevant criminal or safety information exists.

5.9 No Safety Clearance

No search, record result, registry result, matching decision, Identity-Document or Government-ID Review, Photo or Selfie Review, account status, report response, moderation action, or continued access is a safety clearance or endorsement.

Cuddle does not guarantee another member’s identity, age, account ownership, background, criminal history, sex-offender status, truthfulness, intentions, compatibility, availability, safety, or future conduct.

Continue to use caution, protect your information, respect boundaries, and follow the Safety Tips / Dating Safety Notice.

6. Access, Exclusion, Suspension, Notifications, and Appeals

6.1 Sex-Offender-Registration Ineligibility

A person required to register as a sex offender with a registry applicable to that person may not create or maintain a Cuddle account or use the Service.

If Cuddle reasonably determines that a member is subject to such a requirement, Cuddle may restrict, suspend, or terminate the account; limit visibility and communications; preserve records; block re-registration; notify affected persons where required; and take other permitted action.

This rule does not mean that Cuddle checks every member against every registry.

6.2 Other Criminal Convictions and Context-Based Review

Except where the Terms or law provide otherwise, Cuddle does not treat every other criminal conviction as an automatic permanent disqualifier.

Where a record is reasonably matched to a member, Cuddle may consider the conduct’s nature, seriousness, recency, and disposition; relevance to safety or Service integrity; matching confidence; account conduct; reports; continuing risk; and applicable law.

A conviction may result in no action, restriction, suspension, termination, or another proportionate measure. An arrest, allegation, charge, complaint, warrant, or pending matter does not by itself establish guilt.

6.3 Serious Safety, Legal, Fraud, and Service-Integrity Risk

Cuddle may restrict or exclude a member based on information indicating a material safety, legal, fraud, payment-risk, account-integrity, or Service-integrity concern, even without an identified conviction.

Relevant concerns may include violence, sexual misconduct, stalking, trafficking, grooming, child exploitation, serious threats, coercion, financial exploitation, impersonation, account takeover, repeated fraud, prohibited commercial activity, or restriction evasion.

Cuddle may consider the full context rather than a single record, report, result, or risk signal.

6.4 Profile Suspension and Temporary Restrictions

While a review is pending or a material concern remains unresolved, Cuddle may temporarily limit profile visibility, discovery, Likes, Matches, messaging, links, checkout, payment methods, Premium, account access, or other functionality.

Cuddle may request clarification, additional information, an Identity-Document or Government-ID Review, a Photo or Selfie Review, or both through the authenticated review flow made available through the Service.

These reviews do not themselves search criminal records or registries and are not safety clearances. A temporary restriction is not a finding of guilt or a guarantee of a later outcome.

6.5 Account Termination, Barring, and Re-Registration Blocks

Where permitted, Cuddle may terminate or bar an account and block or limit re-registration when it reasonably determines that a member is ineligible or presents a material safety, legal, fraud, payment-risk, account-integrity, or Service-integrity risk.

Cuddle may link related accounts, devices, browsers, sessions, contact information, payment methods, or other signals for enforcement, consistent with the Privacy Policy and law.

A barred person may not use another person, account, identity, device, payment method, VPN, proxy, or external platform to evade the action.

6.6 Notice to Members Who Had Contact With a Restricted Member

Where required by law or Cuddle policy, Cuddle may notify members who communicated with a user later barred for serious fraud or safety concerns.

A notice may identify the profile through a permitted identifier, describe the risk generally, provide safety or fraud guidance, and advise against sending money, credentials, or financial information.

Cuddle may limit details to protect privacy, reporters, investigations, confidential methods, legal obligations, and Service integrity. State-specific notices control recipients, timing, wording, format, and delivery.

6.7 Appeals

Where Cuddle offers an appeal, use the provided method or contact:

Identify the account and action and explain why review is warranted. Cuddle may request information reasonably necessary to assess the appeal, including an Identity-Document or Government-ID Review or Photo or Selfie Review through the authenticated review flow.

An appeal does not guarantee reinstatement, content or Premium restoration, confidential-evidence disclosure, reversal of a payment restriction, or another result.

6.8 No Progressive-Discipline Requirement

Cuddle is not required to use warnings or lesser restrictions before suspension, termination, barring, or stronger action.

A measure may be temporary or permanent, partial or complete, and may occur without prior notice where notice would increase safety, privacy, security, fraud-prevention, payment-risk, investigative, legal, or circumvention risk.

6.9 No Guarantee Created by Action or Inaction

A restriction, suspension, termination, notice, appeal decision, or decision to take no action does not guarantee that Cuddle identified every relevant record, reached a complete factual determination, or eliminated future risk.

Continued access does not mean that a member was screened, cleared, endorsed, or determined safe. No Identity-Document or Government-ID Review, Photo or Selfie Review, account action, or appeal outcome guarantees identity, age, account ownership, background, criminal history, sex-offender status, truthfulness, compatibility, safety, or future conduct.

7. State-Specific Criminal-Background-Screening Disclosures

7.1 General State-Specific Rule and Priority

This Section summarizes criminal-background-screening disclosures that apply in certain states.

Cuddle may provide a more specific registration, communication-gate, website, profile-page, Safety Policy, account, or other state notice. The State-Specific Terms & Cancellation Notices, the specific notice, and non-waivable law control required wording, placement, timing, format, links, acknowledgment, updates, and records.

Providing a notice does not mean every provision of the referenced law applies or that Cuddle screens beyond the practices described here.

7.2 New Jersey Screening Disclosure

For a New Jersey Member:

CUDDLE DOES NOT CONDUCT CRIMINAL BACKGROUND SCREENINGS OR SEX-OFFENDER-REGISTRY CHECKS ON ALL MEMBERS BEFORE THEY MAY COMMUNICATE WITH NEW JERSEY MEMBERS.

In limited, risk-based circumstances, including after reports or other credible information concerning suspected misconduct, Cuddle may investigate whether a member has relevant criminal history. Cuddle may search publicly available state or national sex-offender registries or government public-record databases.

A targeted review may use a name search and available account information to assess whether a public record relates to the member. Where reasonably necessary, Cuddle may request an Identity-Document or Government-ID Review, a Photo or Selfie Review, or both through the authenticated review flow made available through the Service.

Those account-review methods do not themselves search criminal records or sex-offender registries and are not Criminal Background Screening or safety clearances.

A person required to register as a sex offender may not use Cuddle. Another conviction does not automatically disqualify a member. Cuddle may consider the record, matching confidence, account conduct, reports, material risk, applicable law, and Section 6.

Targeted criminal-history reviews are not ordinarily rerun or periodically refreshed unless Cuddle receives new relevant information, states otherwise, or law requires another review.

7.3 Texas No-Background-Check Disclosure

For a Texas Member:

CUDDLE DOES NOT CONDUCT THE CRIMINAL BACKGROUND CHECK DESCRIBED BY TEXAS BUSINESS & COMMERCE CODE SECTION 106.003 ON EACH MEMBER.

Cuddle does not complete that check on every member before permitting a Texas Member to communicate with the member. A profile, account status, Identity-Document or Government-ID Review, Photo or Selfie Review, report outcome, or continued access is not evidence that the described check occurred.

Cuddle may conduct the limited reviews described elsewhere in this Disclosure. If Cuddle begins conducting the described check on each member before communication with a Texas Member, Cuddle will update its disclosures as required.

7.4 Utah Pre-Communication Screening Disclosure

For a Utah Member:

CUDDLE DOES NOT CONDUCT A CRIMINAL BACKGROUND SCREENING ON EACH MEMBER.

Cuddle will provide that disclosure clearly and conspicuously before permitting a Utah Member to communicate through the Service with another member.

Limited, risk-based report, moderation, public-record, fraud-prevention, payment-risk, Identity-Document or Government-ID Reviews, and Photo or Selfie Reviews do not mean Cuddle screens each member. If Cuddle begins screening each member, Cuddle will update the disclosure and provide any additional statement required by law.

7.5 Colorado Safety-Policy Screening and Exclusion Statement

Cuddle’s Colorado Safety Policy will describe Criminal Background Screening, Identity-Document or Government-ID Review, Photo or Selfie Review, and Age-Eligibility Review practices; suspension, barring, appeal, and member-notification practices; prohibited safety-related conduct; reporting guidelines; and safety-tool limits.

Cuddle does not conduct criminal background checks or sex-offender-registry checks on all members. Limited Public-Record Review, Sex-Offender-Registry Review, Identity-Document or Government-ID Review, Photo or Selfie Review, or other account review may occur as described here.

A person required to register as a sex offender may not use Cuddle. Other convictions are evaluated under Section 6 and are not automatic permanent disqualifiers unless the Terms or law require otherwise.

7.6 Placement, Timing, Format, Link, and Acknowledgment

Cuddle will provide state-specific disclosures using the placement, timing, format, link, acknowledgment, accessibility, and language required by law.

Where required:

• New Jersey disclosures will be clear and conspicuous, in bold letters and at least 12-point type, and will appear where personal information is requested or through a conspicuous screening-disclosure link. An applicable profile page will display Cuddle’s update policy or an expressly labeled link.
• The Texas disclosure will appear clearly and conspicuously, in bold capital letters and at least 12-point type, on Cuddle’s website.
• The Utah disclosure will appear before a Utah Member may communicate with another member.
• The Colorado Safety Policy will appear through a clearly labeled link on Cuddle’s main website, applicable account or settings pages, and covered Colorado contracts, in an understandable and reasonably accessible format.

This summary does not replace a separately presented notice required by law.

7.7 Records of Notice Delivery

Cuddle may maintain records of state status, notice triggers, text and version, placement, delivery time, account identifier, registration or communication eligibility, acknowledgment where used, technical result, and policy updates.

The Privacy Policy governs those records.

7.8 Material Changes to Screening Practices

Cuddle will update applicable disclosures if it stops all screening, begins screening all members or all members communicating with residents of a covered state, or materially changes its means, process, sources, update frequency, access policy, exclusion policy, Identity-Document or Government-ID Review practice, Photo or Selfie Review practice, or age-review practice.

Cuddle will provide any notice, link, acknowledgment, profile-page update, Safety Policy update, or other process required by law. A change does not mean earlier members or periods were screened.

7.9 Other States and Non-Waivable Law

Another state or the District of Columbia may require an additional screening disclosure, notice method, access rule, record, or remedy. Cuddle will provide or honor it where required.

No disclosure, screening result, Public-Record Review, Sex-Offender-Registry Review, Identity-Document or Government-ID Review, Photo or Selfie Review, notice, continued access, or absence of action guarantees identity, criminal history, sex-offender status, truthfulness, safety, compatibility, or future conduct.

Nothing in this Section limits any non-waivable screening, safety, privacy, reporting, accessibility, consumer-protection, public-injunctive-relief, court-access, or other right.

8. Privacy, Sensitive Information, Service Providers, Consumer Reports, and Records

8.1 Privacy Policy Controls Personal-Information Processing

The Privacy Policy controls how Cuddle collects, uses, discloses, retains, deletes, and otherwise processes personal information connected to screening, public-record and registry review, Identity-Document or Government-ID Review, Photo or Selfie Review, reports, safety, fraud prevention, payment risk, enforcement, and legal compliance.

This Disclosure explains screening-related practices and limitations. It does not replace the Privacy Policy, a review-specific notice, the State-Specific Terms & Cancellation Notices, or non-waivable law.

8.2 Information Used in a Limited Review

Depending on the concern, Cuddle may use account, profile, contact, age, location, device, browser, transaction, support, report, message, safety, risk, public-record, registry, and enforcement information.

Where reasonably necessary, Cuddle may request identity-document or government-ID images or information, photo or selfie review materials, submission information, and associated account information to assess account ownership, identity consistency, age eligibility, impersonation, fraud, payment risk, safety, compliance, recovery, moderation, or enforcement.

Not every review uses every category, and collecting review information does not mean Cuddle conducts Criminal Background Screening.

8.3 Review-Material Submission Limits

Do not send identity-document images, government identification, photo or selfie review materials, criminal-history or court records, full payment credentials, passwords, authentication codes, bank credentials, private keys, intimate content, information about minors, medical records, or other highly sensitive information through ordinary email, profiles, messages, reports, appeals, support channels, request-an-invite forms, or mail.

Do not use a user-provided link, QR code, external page, or third-party listing to submit review materials.

8.4 Authenticated Review Flow

If Cuddle requests an Identity-Document or Government-ID Review, a Photo or Selfie Review, or both, use only the authenticated review flow made available through the Service and follow the request-specific instructions.

The authenticated review flow is not a payment channel and does not authorize an external purchase, fee, deposit, or transfer of value. Cuddle does not require payment to submit review materials.

Submitting materials does not guarantee account access, reinstatement, completion of a review, a particular finding, or a safety determination.

8.5 Service Providers and Lawful Sources

Cuddle may use service providers to host, secure, store, transmit, support, preserve, or operate systems used for reports, appeals, account review, public-record review, fraud prevention, payment-risk management, moderation, compliance, and enforcement.

Cuddle may also receive information from government records, courts, registries, regulators, law-enforcement authorities, professional advisers, payment participants, users, or other lawful sources.

A provider relationship does not mean Cuddle screens every member or delegates a safety determination.

8.6 Consumer Reports and Legally Required Procedures

Cuddle does not provide consumer reports to users or permit users to run employment, housing, credit, insurance, relationship-status, or similar checks on other members through Cuddle.

If Cuddle uses a consumer reporting agency, obtains a consumer or investigative consumer report, or takes action based on a report for a purpose subject to consumer-reporting law, Cuddle will provide any required disclosure, authorization, summary of rights, copy, notice, adverse-action process, dispute process, or other required procedure.

Nothing here means Cuddle currently obtains consumer reports, conducts comprehensive background checks, or screens every member.

8.7 Use, Disclosure, Retention, and Deletion

Cuddle may create, use, disclose, preserve, and retain review, report, screening-notice, public-record, registry, safety, appeal, fraud-prevention, payment-risk, enforcement, and legal-compliance records as described in the Privacy Policy and law.

After an Identity-Document or Government-ID Review or Photo or Selfie Review is completed and related operational, safety, fraud-prevention, dispute, and legal needs are resolved, Cuddle places submitted review images into its operational deletion process, subject to reasonable processing periods, backup cycles, legal holds, and applicable law.

Cuddle may retain a limited review-result record, including the review type, result or status, completion date, internal reference or reason code, account identifier, and whether another review is required.

8.8 No Sale, Targeted-Advertising Use, or Individual Price Personalization

Cuddle does not sell screening-related or review-related personal information or share it for targeted advertising.

Cuddle does not use identity-document or government-ID materials, photo or selfie review materials, public-record results, registry information, safety, moderation, fraud-prevention, payment-risk, or limited review-result records to personalize the price charged to an individual user.

Privacy rights, correction requests, deletion requests, appeals, and other available processes are governed by the Privacy Policy, applicable notices, and law.

9. User Safety, Reporting, Contact, Changes, and Non-Waivable Rights

9.1 Continue to Use Your Own Judgment

The absence of Criminal Background Screening, a “no record” result, an Identity-Document or Government-ID Review, a Photo or Selfie Review, an account indicator, a report response, an appeal decision, or continued access does not establish that another member is safe, truthful, eligible, or free from criminal history.

Use caution, protect your information, respect boundaries, and follow the Safety Tips / Dating Safety Notice. Screening and account review do not replace your judgment.

9.2 Reporting Safety or Screening Concerns

Report suspected violence, sexual misconduct, stalking, trafficking, grooming, child exploitation, serious fraud, financial exploitation, impersonation, sex-offender-registration ineligibility, or false review claims through reporting tools or to:

Provide truthful information sufficient to identify the account and concern. A report does not require any particular screening, investigation, or action.

9.3 Do Not Put Yourself at Risk to Collect Evidence

Do not continue communicating, meet someone, follow a link, send money, provide sensitive information, or risk harm merely to obtain evidence.

Where lawful and safe, preserve relevant identifiers, dates, messages, links, screenshots, or public-record references. Do not dox, threaten, blackmail, retaliate against, or unlawfully investigate another person.

9.4 Emergency Limits

Cuddle is not an emergency-response service, and its channels may not be monitored in real time.

If there is immediate danger, contact local emergency services without waiting for Cuddle.

Do not send identity-document or government-ID images, photo or selfie review materials, passwords, authentication codes, full payment credentials, medical records, information about minors, or other highly sensitive information through ordinary email. If requested, use only Cuddle’s authenticated review flow.

9.6 Relationship to Other Terms and Priority

This Disclosure is an Additional Term under the Terms of Service.

The Terms govern eligibility, accounts, safety, review, and enforcement. The Safety Tips provide practical guidance. The Community Guidelines govern user conduct. The Privacy Policy governs personal-information processing. The State-Specific Terms & Cancellation Notices govern state-specific disclosures and non-waivable requirements.

A more specific review notice, state notice, or non-waivable law controls its subject.

9.7 Changes, Effective Date, and Prior Versions

Cuddle may update this Disclosure prospectively as its practices, sources, exclusion policies, or law change.

For a material update, Cuddle will revise the Effective Date or Last Updated date and provide any required process. Cuddle may retain prior versions and compliance records.

9.8 Accessibility and Non-Discrimination

Cuddle will make this Disclosure and reporting and appeal methods reasonably accessible where required.

Cuddle will not unlawfully discriminate or retaliate solely because a person makes a good-faith report, appeals, requests accessibility support, or exercises a protected right.

9.9 Non-Waivable Rights and Final No-Authorization Provision

Nothing in this Disclosure limits any non-waivable screening, safety, reporting, appeal, privacy, accessibility, anti-discrimination, consumer-protection, public-injunctive-relief, court-access, or other right under law.

No screening practice, result, Public-Record Review, Sex-Offender-Registry Review, Identity-Document or Government-ID Review, Photo or Selfie Review, report response, enforcement action, continued access, or appeal outcome guarantees identity, age, account ownership, background, criminal history, sex-offender status, truthfulness, safety, compatibility, or future conduct.

No screening practice, notice, review, report, appeal, support response, or legal remedy authorizes Prohibited Services, Prohibited Payments, user-to-user transfers of value, abuse, exploitation, unsafe conduct, or unlawful activity.
