Cuddle Criminal Background Screening Disclosure

1. About This Disclosure

1.1 Purpose and Operator

Third Hub US, Inc., doing business as Cuddle (“Cuddle,” “we,” “us,” or “our”), provides this Disclosure to explain our criminal-background screening practices, their limits, and applicable state notices.

1.2 Who This Disclosure Covers

This Disclosure applies to Cuddle's U.S. Service, designed for married or partnered adults 18 or older, including Free Access and Premium members. Read it with our Terms of Service, Privacy Policy, Community Guidelines, State-Specific Terms & Cancellation Notices, and separate Safety Policy.

1.3 Core Screening Notice

CUDDLE DOES NOT CONDUCT CRIMINAL BACKGROUND OR SEX OFFENDER REGISTRY CHECKS ON EVERY MEMBER.

Members you communicate with may not have been screened. Limited, risk-based reviews may occur following reports or other credible information. A profile, Match, completed review, badge, or Premium subscription does not establish that criminal screening occurred or guarantee identity, background, or safety. State-specific disclosures appear in Section 6.

2. Current Screening Practices

2.1 No Screening of Every Member

Cuddle does not check every member's criminal history or sex-offender-registration status. Most members are not expected to undergo criminal-history review. Criminal screening is not a universal prerequisite to registration, matching, or communication.

2.2 Limited Risk-Based Reviews

Following reports or other credible information, Cuddle may conduct limited account or public-record reviews to assess safety, fraud, legal, or Service-integrity concerns. A report does not itself establish wrongdoing or guarantee that a criminal-record search will occur.

2.3 Public Records and Account Matching

Reviews may include searches of public sex-offender registries or government criminal-record databases. We may compare names and available account information to assess whether a record concerns the member. A possible match is not conclusive proof of identity. Records and matching information may be incomplete, outdated, or inaccurate. Section 3 explains further limitations.

2.4 Screening Update Policy

These reviews are not routinely repeated or updated unless new information, a disclosed practice, or applicable law requires otherwise. A previous review does not establish a member's current background or safety. We will update disclosures and provide required notices when our screening practices change.

3. Screening Scope and Limitations

3.1 Records Included and Excluded

Our limited criminal-history searches cover publicly available conviction records and may include public sex-offender registries. They do not cover arrests, nonpublic convictions, or convictions from foreign countries. A review does not establish that every relevant court, registry, jurisdiction, or database was searched. These limits concern criminal-history searches; they do not prevent review of reported misconduct under our Terms and Community Guidelines.

3.2 Incomplete and Outdated Information

Not all criminal records are public or available in every database. Records may be missing, delayed, outdated, or inaccurate. Conduct that was never reported or did not result in a publicly available conviction may not appear. Finding no record does not mean no harmful conduct occurred.

3.3 Incorrect Matches and Identity Evasion

Names and account information may be incomplete, inaccurate, or shared by different people. A search may identify the wrong person or fail to identify the correct person. People may use false details or evade even sophisticated searches. Report suspected mistaken identity through Section 7; do not send identity documents by email.

3.4 No Guarantee of Safety

Criminal-background screening is not foolproof, may create a false sense of security, and is not a complete safety solution. No search, review, profile, badge, or Premium subscription guarantees identity, age, background, intentions, or safety. Use our Safety Tips / Dating Safety Notice for practical guidance. You may report concerning behavior without establishing a criminal conviction.

4. Identity, Age, and Photo Reviews

4.1 Limited Review Requests

Cuddle does not routinely require government-issued ID or current-photo review at signup. When reasonably necessary to assess age, identity, safety, fraud, or account-integrity concerns, we may request authentic documents or a current photo.

4.2 Authenticated Submission Only

Provide requested materials only through the authenticated review flow within the Service. Do not submit them through profiles, messages, reports, email, support tickets, external forms, or mail. If unsure about a request, contact support@cuddle-global.com without attaching documents.

4.3 Review Methods and Limits

Cuddle does not use automated facial recognition, biometric templates, or liveness analysis. Document or photo review alone is not criminal-background screening and does not guarantee identity, age, background, intentions, or safety. Review materials are handled under our Privacy Policy.

5. Eligibility and Review Outcomes

5.1 Sex-Offender Registration Restrictions

Persons required to register as sex offenders are ineligible to use Cuddle under our Terms of Service. This restriction applies even if a required registration is missing from a public registry or has not been identified through a review. Our limited reviews do not establish that every ineligible person has been detected or excluded.

5.2 Other Criminal Convictions

Other criminal convictions do not automatically disqualify a member. A member with another conviction may retain access and communicate with other members, including members in states covered by Section 6. Information indicating material safety, legal, fraud, or Service-integrity risks may lead to restrictions or termination under our Terms and Community Guidelines.

5.3 Restrictions, Continued Access, and Enforcement

We may consider available records, account information, reported conduct, and surrounding circumstances when reviewing concerns. A report or possible record match does not itself prove wrongdoing. We may restrict, suspend, or terminate access as permitted by our Terms and applicable law.

Continued access does not establish that screening occurred or that a member is safe. For mistaken identity, inaccurate information, or appeals, follow Section 7. Reports and review information are handled under our Privacy Policy.

6. State-Specific Screening Disclosures

These notices apply where the relevant state law governs. Sections 2–5 describe our limited reviews, their limitations, and eligibility rules. We will provide required notices clearly and conspicuously.

6.1 New Jersey

CUDDLE DOES NOT CONDUCT CRIMINAL BACKGROUND SCREENINGS OR SEX-OFFENDER-REGISTRY CHECKS ON ALL MEMBERS BEFORE THEY MAY COMMUNICATE WITH NEW JERSEY MEMBERS.

New Jersey members include those providing a New Jersey address or ZIP code at registration.

Limited reviews may involve public registries or government records and account matching, as described in Section 2. Our update policy is in Section 2.4. Persons required to register as sex offenders are ineligible. Members with other convictions may otherwise retain access and communicate with New Jersey members.

Required disclosures will appear in bold, at least 12-point type, on personal-information collection pages or through conspicuous, expressly labeled links. Profiles will display the update policy or an expressly labeled link.

6.2 Texas

CUDDLE DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS AS DESCRIBED BY TEXAS BUSINESS & COMMERCE CODE SECTION 106.003 ON EACH MEMBER BEFORE PERMITTING TEXAS MEMBERS TO COMMUNICATE WITH OTHER MEMBERS.

Texas members provide a Texas billing address or ZIP code when registering. This notice will appear on our website in bold, capital letters, at least 12-point type. Limited reviews described in Section 2 do not establish comprehensive screening of every member.

6.3 Utah

CUDDLE DOES NOT CONDUCT CRIMINAL BACKGROUND SCREENING ON EACH MEMBER.

Utah members provide a Utah billing address or ZIP code when registering. We will provide this notice before permitting Utah members to communicate through the Service with other members.

6.4 Illinois

CUDDLE DOES NOT CONDUCT CRIMINAL BACKGROUND SCREENINGS ON ALL COMMUNICATING MEMBERS.

Illinois members provide an Illinois billing address or ZIP code when registering. We will provide required notices in bold, capital letters, at least 12-point type, using at least two permitted formats: member emails, an acknowledgment screen, member profiles, or registration pages.

Sections 2–3 explain limited reviews and screening limitations. Subject to Section 5, members with other convictions may retain access and communicate with Illinois members.

6.5 Connecticut

CUDDLE DOES NOT CONDUCT CRIMINAL BACKGROUND SCREENING ON EACH USER.

We will provide this notice at registration and before permitting Connecticut users to communicate with others. The registration communication will contain only screening and safety-awareness notices.

If a character-limited communication links to full notices, the destination will contain only those notices. Connecticut users include those providing a Connecticut home address or ZIP code, or known or determined to be in Connecticut, at registration.

6.6 Colorado

Cuddle does not conduct criminal-background or sex-offender-registry checks on every member. Sections 2–5 describe limited reviews, identity and age review, and exclusion criteria.

Our separate Safety Policy addresses these practices together with reporting, enforcement, appeals, member notifications, and safety resources. This Disclosure supplements that policy and does not replace required Colorado notices or procedures.

7. Reporting, Corrections, and Privacy

7.1 Reporting Safety Concerns

Report concerns using in-Service tools or safety@cuddle-global.com. Identify the account and relevant facts. You do not need to establish a criminal conviction. Reporting, blocking, and unmatching are free. For immediate danger, contact local emergency services. Cuddle's channels are not emergency services.

7.2 Mistaken Identity and Appeals

For suspected mistaken identity, inaccurate review information, or an appeal, use the method in our notice or contact support@cuddle-global.com. Explain the issue and provide relevant, accurate information. We may uphold, modify, or reverse decisions under our Terms and Community Guidelines. Cuddle does not control external records.

7.3 Privacy and Safe Evidence

We handle reports and review information under our Privacy Policy. Contact privacy@cuddle-global.com for personal-information requests. Do not email IDs, review images, intimate images, passwords, codes, or payment credentials. Submit requested ID or current-photo materials only through our authenticated in-Service review flow. Request secure instructions for other sensitive evidence. Do not risk your safety to collect evidence. Do not download, copy, or forward suspected child sexual abuse material.

Reporter identities are not ordinarily disclosed solely because of a report; disclosure may be necessary for lawful review, enforcement, or legal obligations. Anonymity is not guaranteed.

8.1 Changes to Screening Practices

We may change our screening practices and will update this Disclosure and its Last Updated date accordingly. Changes apply prospectively. Before changes take effect, we will provide notices and obtain consent as required by our Terms of Service or applicable law.

8.2 Related Policies and Protected Rights

This Disclosure supplements our Terms of Service, Community Guidelines, Privacy Policy, State-Specific Terms & Cancellation Notices, and separate Safety Policy. State-specific provisions control conflicting general terms for covered matters, subject to non-waivable law. More specific lawful notices govern their stated subjects. Our Privacy Policy governs personal-information processing. Nothing here limits non-waivable rights or good-faith reporting and help-seeking.
