Cuddle Criminal Background Screening Disclosure

1. Introduction and Scope

1.1 Purpose of This Disclosure

Cuddle is an 18+ online dating and social connection service for eligible adults.

This Criminal Background Screening Disclosure (“Disclosure”) explains whether and how Cuddle may conduct criminal background screening, sex offender registry screening, public-record review, verification, account-integrity review, safety review, or related checks in connection with the Service.

This Disclosure is intended to help users understand the limits of screening, verification, badges, account indicators, safety tools, fraud-prevention tools, payment-risk tools, and related features.

1.2 How This Disclosure Applies

This Disclosure is Additional Terms under the Cuddle Terms of Service.

It applies to accounts, profiles, verification features where used, badges or account indicators where used, reports, safety reviews, moderation, enforcement, appeals, support requests, and user interactions connected to Cuddle.

It also applies to any state-specific dating safety notice, screening notice, criminal background screening notice, fraud notice, or similar disclosure that Cuddle provides, except where a more specific notice or applicable law controls.

1.3 No Safety Guarantee

No criminal background screening, sex offender registry screening, public-record review, verification feature, badge, account indicator, safety tool, fraud-prevention tool, payment-risk tool, moderation action, report review, or similar process guarantees that a user is safe, truthful, eligible, available, compatible, trustworthy, verified, or appropriate to interact with.

You are responsible for using your own judgment when communicating with users, sharing information, moving conversations off Cuddle, meeting in person, or taking any action based on another user’s profile, message, status, or conduct.

1.4 Relationship to Other Safety Rules

This Disclosure should be read together with the Terms of Service, Privacy Policy, Community Guidelines, Safety Tips / Dating Safety Notice, Prohibited Services, Payments & Commerce Policy, State-Specific Terms & Cancellation Notices, Contact / Legal Notices, and applicable law.

If there is a conflict regarding personal information, the Privacy Policy controls. If there is a conflict regarding state-specific screening notices or non-waivable rights, the applicable state-specific notice or law controls to the extent required.

2. Important Disclosure: No Comprehensive Background Checks

2.1 Cuddle Does Not Screen All Users

Unless Cuddle expressly states otherwise for a specific feature, program, jurisdiction, or user category, Cuddle does not conduct criminal background checks, sex offender registry checks, identity verification checks, relationship-status checks, marital-status checks, intention checks, employment checks, financial checks, health checks, immigration checks, social-media checks, or safety clearances on all users.

Cuddle is not a background-check service, private investigation service, law-enforcement service, personal security service, professional matchmaking service, or identity-verification service for all users.

You should not assume that a user has been screened, cleared, approved, investigated, verified, or determined to be safe by Cuddle merely because the user has an account, profile, match, message, badge, account indicator, Paid Feature, prior interaction, or access to the Service.

2.2 No Continuous Monitoring

Cuddle does not continuously monitor all users against criminal records, sex offender registries, court records, arrest records, civil records, public records, social media, relationship-status records, marital-status records, employment records, financial records, immigration records, health records, or other databases.

A user’s circumstances may change after account creation, after a verification step, after a report review, after a safety review, after a paid purchase, after a match, or after a prior interaction.

Information that appears accurate at one time may later become outdated, incomplete, misleading, or incorrect.

2.3 No Guarantee About Users

The absence of a criminal background check, sex offender registry check, public-record review, report, enforcement action, warning, suspension, or account restriction does not mean that a user is safe, truthful, eligible, available, compatible, trustworthy, verified, or appropriate to interact with.

Likewise, any verification feature, badge, account indicator, screening result, safety feature, fraud-prevention tool, payment-risk tool, moderation action, or report review does not guarantee any user’s identity, age, background, criminal history, sex offender status, relationship status, marital status, intentions, truthfulness, safety, availability, compatibility, or suitability.

2.4 Your Responsibility

You are responsible for using your own judgment when communicating with another user, sharing information, moving a conversation off Cuddle, meeting in person, traveling, or taking any action based on another user’s profile, message, status, badge, account indicator, statement, request, or conduct.

You should review and follow the Safety Tips / Dating Safety Notice, use reporting and blocking tools where appropriate, and contact local emergency services immediately if you are in immediate danger or believe another person is in immediate danger.

3. Verification, Badges, Account Indicators, and Safety Tools

3.1 Verification Features

Cuddle may offer or require verification features where supported. Verification features may include email verification, phone verification, age checks, photo or selfie checks, liveness checks, identity document checks, payment-method verification, billing verification, account ownership checks, device checks, location or residency confirmation, or similar account-integrity steps.

Verification features are designed to support account integrity, eligibility review, safety review, fraud prevention, payment-risk management, or legal compliance. They are not comprehensive criminal background checks, sex offender registry checks, safety clearances, or guarantees of a user’s identity, intentions, truthfulness, background, or conduct.

3.2 Badges and Account Indicators

Cuddle may display badges, account indicators, verification labels, safety indicators, or similar signals where supported.

These indicators may be limited in scope and may reflect only a particular step, feature, status, review, or signal at a particular time. They may be based on user-provided information, third-party information, technical signals, payment-risk signals, fraud-prevention signals, or other information available to Cuddle.

A badge, indicator, or label does not mean that Cuddle has fully verified a user’s identity, criminal history, sex offender status, relationship status, marital status, intentions, employment, finances, health, safety, compatibility, availability, or suitability.

3.3 Safety and Risk Tools

Cuddle may use reporting tools, blocking tools, moderation tools, fraud-prevention tools, payment-risk tools, account-integrity tools, device checks, linked-account analysis, automated review, machine-assisted review, human review, or service-provider tools to support safety and Service integrity.

These tools may help detect or respond to suspected fraud, scams, account takeover, payment abuse, prohibited services, prohibited payments, harassment, impersonation, minor safety concerns, or other misuse. However, they may be limited, delayed, unavailable, incomplete, inaccurate, or unable to identify every risk.

3.4 No Reliance on Verification Alone

You should not rely only on verification features, badges, account indicators, safety tools, fraud-prevention tools, payment-risk tools, profiles, messages, photos, or another user’s statements when deciding whether to trust someone, share information, move off Cuddle, meet in person, travel, or continue communication.

Use your own judgment, follow the Safety Tips / Dating Safety Notice, and report safety concerns where appropriate.

4. Limited Reviews, Public Records, and Risk-Based Checks

4.1 Limited Reviews May Occur

Although Cuddle does not conduct background checks, registry checks, or safety clearances on all users, Cuddle may conduct limited, risk-based, or event-based reviews where we reasonably determine that a review is necessary or appropriate.

A limited review may occur in response to a user report, safety concern, minor safety concern, suspected impersonation, suspected account takeover, suspected prohibited services, suspected prohibited payments, suspected fraud, payment abuse, chargeback abuse, harassment, stalking, blackmail, extortion, sextortion, doxxing, legal request, law-enforcement request, service-provider request, processor concern, or other safety, legal, fraud-prevention, payment-risk, moderation, or enforcement concern.

4.2 Sources We May Review

A limited review may involve information available through Cuddle, information submitted by users, reports, messages, profiles, screenshots, links, QR codes, payment handles, wallet addresses, support communications, billing communications, account records, device information, IP address information, payment-risk signals, fraud-prevention signals, verification information where used, and related records.

Where permitted by law and appropriate for the concern being reviewed, Cuddle may also review public records, publicly available information, service-provider information, vendor information, payment processor information, fraud-prevention information, payment-risk information, regulator information, law-enforcement information, court records, sex offender registry information, or other lawful sources.

4.3 Limited Review Is Not Comprehensive Screening

A limited review does not mean that Cuddle screens all users, continuously monitors all users, verifies every user’s identity, checks every public record, checks every sex offender registry, or conducts a criminal background check on every user.

A limited review may be narrow, delayed, incomplete, unavailable, jurisdiction-limited, legally restricted, dependent on information provided to Cuddle, or dependent on third-party information.

Cuddle may decide not to conduct a review, may be unable to conduct a review, or may be unable to confirm whether a concern is accurate, complete, current, or connected to a particular user.

4.4 Possible Actions After Review

After a limited review, Cuddle may take action permitted by the Terms of Service, this Disclosure, the Community Guidelines, the Safety Tips / Dating Safety Notice, the Prohibited Services, Payments & Commerce Policy, the Privacy Policy, and applicable law.

Actions may include no action, additional review, requesting information, limiting features, removing content, restricting visibility, limiting messaging, blocking payment methods, revoking Paid Features, requiring verification, preserving records, suspending or terminating accounts, reporting where legally required or appropriate, cooperating with service providers or lawful authorities, or taking other appropriate action.

A review outcome does not guarantee user safety, record accuracy, future conduct, or any particular result.

5. User Eligibility, Safety Representations, and Account Actions

5.1 Safety-Related Eligibility

To the fullest extent permitted by applicable law, by creating an account, using Cuddle, communicating with users, submitting content or reports, responding to verification requests, or purchasing or using Paid Features, you represent that you are eligible to use Cuddle safely and lawfully.

This includes representing that you are not required to register as a sex offender with any federal, state, local, territorial, tribal, military, or foreign registry, and that you have not been prohibited by law, court order, or applicable authority from using a dating, communication, social connection, or online platform service.

5.2 Safety and Conduct Representations

You represent that your use of Cuddle will not create a material safety risk to any user, minor, third party, service provider, payment processor, or Cuddle.

You may not use Cuddle for harassment, stalking, exploitation, human trafficking, sexual misconduct, child exploitation, violence, threats, fraud, blackmail, extortion, sextortion, doxxing, payment abuse, impersonation, prohibited services, prohibited payments, user-to-user transfers of value, or similar prohibited conduct.

5.3 Accuracy and No Evasion

If Cuddle requests information related to eligibility, safety, account integrity, verification, legal compliance, fraud prevention, payment-risk management, or enforcement, you must provide accurate, current, complete, and non-misleading information.

You may not use false information, altered documents, alternate accounts, third-party accounts, payment methods, devices, VPNs, proxies, or other workarounds to evade eligibility rules, safety reviews, verification, enforcement actions, or this Disclosure.

5.4 Account Actions and Screening Limits

If Cuddle reasonably believes that you are ineligible, required to register as a sex offender, prohibited from using the Service, creating safety risk, providing false or misleading information, evading review, or violating applicable terms or law, Cuddle may request information, require verification, remove content, limit visibility or messaging, block payment methods, restrict purchases, revoke Paid Features, preserve records, suspend or terminate accounts, report where legally required or appropriate, cooperate with service providers or lawful authorities, or take other appropriate action.

These representations and actions do not mean that Cuddle screens all users, verifies all statements, continuously monitors all users, or guarantees that any user is safe, truthful, eligible, available, compatible, trustworthy, verified, or appropriate to interact with.

6. Screening Limits, Record Limits, and No Safety Guarantee

6.1 Screening and Record Sources Have Limits

Any criminal background screening, sex offender registry screening, public-record review, verification review, account-integrity review, safety review, or similar review may be limited by the information available to Cuddle, the information available to service providers, the information available in public records, the information provided by users, applicable law, technical limitations, jurisdictional limitations, and operational constraints.

Records may be incomplete, outdated, unavailable, inaccurate, sealed, expunged, restricted, delayed, misclassified, duplicated, mismatched, or difficult to connect to a specific person.

A review may not identify all arrests, charges, convictions, restraining orders, civil matters, registry information, aliases, name changes, records from other jurisdictions, recent events, pending matters, sealed records, expunged records, foreign records, military records, tribal records, or records unavailable to Cuddle or its service providers.

6.2 Sex Offender Registry and Criminal Record Limits

Sex offender registries, criminal databases, court records, and public records may vary by jurisdiction, may use different reporting standards, may be updated at different times, and may contain incomplete or inaccurate information.

A registry or criminal-record search may miss records because of name variations, spelling differences, aliases, incomplete identifiers, incorrect dates of birth, missing location information, unavailable records, legal restrictions, data delays, or limitations in the source being searched.

A possible match does not necessarily establish that the record belongs to a particular user, that the record is complete, that the record is current, or that the user currently presents a specific risk.

6.3 Clean Results Do Not Guarantee Safety

A lack of a record, a clean result, a non-match, a verification result, a badge, an account indicator, a safety review, or the absence of an enforcement action does not mean that a user is safe, truthful, eligible, available, compatible, trustworthy, verified, or appropriate to interact with.

A user may have no available record and still act unsafely. A user may pass a limited review and later engage in unsafe, deceptive, unlawful, abusive, fraudulent, coercive, or prohibited conduct.

Screening, verification, and safety tools cannot predict every user’s future conduct, intentions, truthfulness, emotional state, relationship status, availability, financial situation, health, safety, or compatibility.

6.4 No Ongoing Duty or Comprehensive Safety Guarantee

Unless Cuddle expressly states otherwise for a specific feature, program, jurisdiction, or user category, Cuddle does not continuously monitor all users, repeat screening at set intervals, review every public record, review every report immediately, or guarantee that any information associated with a user is current.

Cuddle does not guarantee that we will detect, prevent, investigate, confirm, remove, restrict, suspend, terminate, or report every unsafe user, ineligible user, prohibited user, false statement, suspicious account, public-record issue, registry issue, safety issue, or policy violation.

You should use your own judgment, follow the Safety Tips / Dating Safety Notice, protect your information, report safety concerns, and contact local emergency services immediately if you are in immediate danger or believe another person is in immediate danger.

7. Privacy, Sensitive Information, Vendors, and Consumer Reports

7.1 Privacy Policy Controls

Cuddle may process personal information in connection with verification, account integrity, safety reviews, reports, moderation, fraud prevention, payment-risk management, support, enforcement, and related operations.

This may include account information, profile information, eligibility information, verification information where used, government identification information where used, selfie or photo verification information where used, liveness or biometric-related information where used, reports, evidence, device information, IP address information, payment-risk signals, fraud-prevention signals, vendor records, and related communications.

Our Privacy Policy controls how Cuddle handles personal information.

7.2 Sensitive Information

Do not send government identification documents, biometric information, criminal-history records, court records, medical records, financial records, private keys, wallet credentials, passwords, authentication codes, full payment card numbers, card security codes, full bank account credentials, or other highly sensitive information by ordinary email unless Cuddle specifically requests it through an appropriate method.

If Cuddle requests sensitive information for verification, safety review, account integrity, legal compliance, fraud prevention, payment-risk management, or enforcement, we may provide instructions or a more appropriate submission method where available.

7.3 Vendors and Lawful Sources

Cuddle may use service providers or vendors to support verification, age review, identity review, account integrity, selfie or photo review, liveness checks, fraud prevention, payment-risk management, safety review, public-record review, or related functions where used.

Those providers may process information under their own terms, privacy policies, legal obligations, and security practices, or under agreements with Cuddle where applicable.

Cuddle may also review information from lawful sources as described in this Disclosure, the Privacy Policy, and applicable law.

7.4 Consumer Reports and Required Notices

If Cuddle uses a consumer reporting agency, obtains a consumer report, or takes action based on a consumer report where applicable law requires separate notice, authorization, adverse-action notice, dispute rights, or consumer-rights disclosures, Cuddle will provide the required process to the extent required by law.

Nothing in this Section means that Cuddle obtains consumer reports, conducts comprehensive background checks, or screens all users.

7.5 Use, Disclosure, and Retention

Cuddle may use, disclose, and retain screening-related, verification-related, safety-related, fraud-related, payment-risk-related, support-related, and enforcement-related records where reasonably necessary to protect users, prevent fraud, manage payment risk, investigate reports, enforce applicable terms, comply with law, cooperate with service providers, and exercise legal rights.

8. State-Specific Notices, Contact, Relationship to Other Terms, and Changes

8.1 State-Specific Screening and Safety Notices

Certain U.S. states may require dating service notices, criminal background screening disclosures, safety notices, sex offender registry disclosures, verification disclosures, or similar consumer notices.

Cuddle may provide state-specific information through the State-Specific Terms & Cancellation Notices, this Disclosure, Safety Tips / Dating Safety Notice, Community Guidelines, account notices, checkout disclosures, or another legally permitted method.

If applicable law requires a specific notice about whether Cuddle conducts criminal background screening, sex offender registry screening, public-record review, verification, or similar checks, Cuddle will provide that notice to the extent required.

Do not send government identification documents, biometric information, criminal-history records, court records, passwords, authentication codes, payment card numbers, bank credentials, private keys, wallet credentials, or other highly sensitive information by ordinary email unless Cuddle requests it.

8.3 Relationship to Other Terms

This Disclosure should be read together with the Terms of Service, Privacy Policy, Community Guidelines, Safety Tips / Dating Safety Notice, Prohibited Services, Payments & Commerce Policy, State-Specific Terms & Cancellation Notices, Contact / Legal Notices, and applicable law.

The Terms of Service control account eligibility and enforcement. Community Guidelines control user-facing behavior rules. Safety Tips / Dating Safety Notice controls dating safety guidance. Privacy Policy controls personal information. Prohibited Services, Payments & Commerce Policy controls prohibited services, prohibited payments, and restricted commerce.

If there is a conflict regarding state-specific screening disclosures, dating safety notices, consumer notices, or non-waivable rights, the applicable state-specific notice or law controls.

8.4 Changes and Non-Waivable Rights

Cuddle may update this Disclosure and will provide notice where required by law.

No update guarantees that Cuddle screens all users, continuously monitors all users, verifies every user’s identity, or determines that any user is safe, truthful, eligible, available, compatible, trustworthy, verified, or appropriate.

Nothing in this Disclosure limits any non-waivable privacy, safety, reporting, consumer-protection, payment, cancellation, refund, accessibility, anti-discrimination, appeal, or other right that may apply under applicable law.
